ANNOUNCED AS TEMPORARYNo
On September 5, 2013, the Argentinian authorities decided, after having conducted an expiry review, to extend the anti-dumping duty on imports of microwave ovens with capacity up to 37 liters from China (Resolution 491/2013, 05.09.2013).
The products subject to the duty are classified under the following HS code: 8516.5000. The amount of the duty is the difference between the FOB declared by the importer and a minimum FOB set at 74.40 USD per piece for mechanical microwave ovens with capacity up to 37 liters, 96.26 USD per piece for digital microwave ovens with capacity up to 24 liters and 118.56 USD per piece for microwave ovens whose capacity is larger than 24 liters but does not exceed 37 liters. This definitive anti-dumping duty entered into force on the day of the signature of the resolution, i.e. on September 5, 2013, and is applicable for a period of five years.
This duty follows an expiry review requested by the Association of the Argentinian Electronic Factories (Asociación de Fábricas Argentinas de Terminales de Electrónica - AFARTE). A review was then initiated by the Argentinian Ministry of Economy and Public Finance on March 7, 2012 (Resolution 50/2012, 07.03.2012). The review started on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on March 8, 2012. The original anti-dumping duty on microwave ovens was decided on December 13, 2002 (Resolution 103/2002, 13.12.2002). It was then already extended on March 5, 2007 (Resolution 98/2007, 05.03.2007) for five years.
