Anti-dumping

On December 13, 2011, the Mexican authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of liquid caustic soda from the United States of America (Resolución final del examen de vigencia y de la revisión de oficio de la cuota compensatoria impuesta a las importaciones de sosa cáustica líquida..., 13.12.2011).

The product subject to the duty is classified under the following HS code: 2815.1201. The amount of the duty is the difference between the export price (ex-works price) and the reference price of USD 288.71 per metric ton. The duty should however not exceed 54.79%. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on January 4, 2012, for a period of five years (from July 13, 2010 onwards).

This duty follows an expiry review requested on June 8, 2010 by Industria Química del Istmo S.A. de C.V. and Mexichem Derivados S.A. de C.V. A review was then initiated by the Mexican Ministry of Economy on June 25, 2010 (Resolución por la que se declara el inicio del examen de vigencia y de la revisión de oficio de las cuotas compensatorias impuestas a las importaciones de sosa cáustica líquida..., 25.06.2010). The review started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on July 6, 2010. In a preliminar resolution on August 8, 2011, the Mexican authorities announced the continuation of the review (Resolución preliminar de la revisión de oficio de las cuotas compensatorias impuestas a las importaciones de sosa cáustica líquida..., 08.08.2011).

The original anti-dumping duty entered into force on July 13, 1995 (Resolución final de la investigación anti-dumping sobre las importaciones de sosa cáustica líquida..., 26.06.1995). It was then extended a first time on June 7, 2003 for a period of five years starting on July 13, 2000 (Resolución final del examen para determinar las consecuencias de la supresión de la cuota compensatoria definitiva impuesta a las importaciones de sosa cáustica líquida..., 27.05.2003) and a second time on June 7, 2006 for a period of five years starting on July 13, 2005 (Resolución final del examen de vigencia de la cuota compensatoria impuesta a las importaciones de sosa cáustica..., 29.05.2006).

On June 18th, 2015, the Mexican Ministry of Economy decided to initiate a new sunset review of the anti-dumping duty imposed on imports of liquid caustic soda originating in the United States of America.
This review follows the application lodged on June 4th, 2015 by Industria Química del Istmo, S.A. de C.V., Mexichem Derivados, S.A. de C.V. and Petroquímica Mexicana de Vinilo, S.A. de C.V.
The investigation started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on July 8th, 2015. The existing anti-dumping measure remains in force during the review.
 
On 30 July 2016, the Mexican authorities extended the definitive anti-dumping duty on imports of liquid caustic soda originating in the United States of America. The rate of duty remains the difference between the export price (ex-works price) and the reference price of USD 288.71 per metric ton, however not exceeding a duty of54.79%. The measure remains in force for a period of five years from 13 July 2015.
