Anti-dumping

On November 10, 2009, the Mexican authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of polyester staple fibres from South Korea (Resolución final del examen de vigencia de las cuotas compensatorias impuestas a las importaciones de poliéster fibra corta..., 10.11.2009).
 
The products subject to the duty are classified under the following HS codes: 5503.2001, 5503.2002, 5503.2003 and 5503.2099. The rate of the duty ranges from 3.74% to 32.00%, depending on the Korean exporter. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on November 21, 2009, for a period of five years (from August 20, 2008 onwards).
 
This duty follows an expiry review requested on July 15, 2008 by Akra Polyester S.A. de C.V. A review was then initiated by the Mexican Ministry of Economy on August 14, 2008 (Resolución por la que se declara de oficio el inicio del examen de vigencia de las cuotas compensatorias impuestas a las importaciones de poliéster fibra corta..., 14.08.2008). The review started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on August 20, 2008.
 
The original anti-dumping duty entered into force on August 20, 1993 (Resolución definitiva sobre la importación de poliéster fibra corta..., 06.08.1993). It was then extended a first time on July 30, 1999 for a period of five years starting on August 20, 1998 (Resolución final del examen para determinar las consecuencias de la supresión de las cuotas compensatorias definitivas impuestas a las importaciones de poliéster fibra corta..., 08.07.1999) and a second time on December 11, 2004 for a period of five years starting on August 20, 2003 (Resolución final del examen de vigencia de la cuota compensatoria impuesta a las importaciones de poliéster fibra corta..., 26.11.2004). On July 11, 2013, DAK Resinas Américas México S.A. de C.V. lodged a request for a fourth expiry review before the extended duty imposed on November 10, 2009 expires.
 
A review was then initiated by the Mexican Ministry of Economy on July 31, 2013 (Resolución por la que se declara el inicio del examen de vigencia de la cuota compensatoria impuesta a las importaciones de poliéster fibra corta..., 31.07.2013). The review started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on August 8, 2013.
On June 13, 2014, the Mexican authorities terminated the review and decided upon the continuation of the anti-dumping measure imposed on imports of polyester staple fibres originating in South Korea. The rate of the duty remains unchanged (see above). This duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on June 27, 2014. It shall be enforced for a period of five years, starting from August 20, 2013.

On 17 August 2018, the Mexican authorities initiated a sunset review of the definitive antidumping duty imposed on imports of the subject good from the Republic of Korea. This follows the request lodged on 11 July 2017 by DAK Resinas Américas México, S.A. de C.V. The existing antidumping measure remains in force during the review.
