Anti-dumping

On November 8, 2012, the Mexican authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of rolled steel plates from Russia (Resolución final del examen de vigencia y de la revisión de oficio de las cuotas compensatorias impuestas a las importaciones de placa de acero en rollo..., 08.11.2012).

The products subject to the duty are classified under the following HS codes: 7208.1002, 7208.2599 and 7208.3701. The rate of the duty is 29.30% for all Russian exporters. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on November 23, 2012, for a period of five years (from June 8, 2011 onwards).

This duty follows an expiry review requested on April 29, 2011 by Ternium México S.A. de C.V. and on May 2, 2011 by Altos Hornos de México S.A.B. de C.V. A review was then initiated by the Mexican Ministry of Economy on June 1, 2011 (Resolución por la que se declara el inicio de los procedimientos de examen de vigencia y de la revisión de oficio de la cuota compensatoria impuesta a las importaciones de placa de acero en rollo..., 01.06.2011). The review started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on June 7, 2011.

In a preliminar resolution on June 13, 2012, the Mexican authorities announced the continuation of the review (Resolución preliminar de la revisión de oficio de la cuota compensatoria impuesta a las importaciones de placa de acero en rollo..., 13.06.2012).

The original anti-dumping duty entered into force on June 8, 1996 (Resolución final de la investigación anti-dumping sobre las importaciones de placa de acero en rollo..., 04.06.1996). It was then extended a first time on June 12, 2003 for a period of five years starting on June 8, 2001 (Resolución final del examen para determinar las consecuencias de la supresión de la cuota compensatoria definitiva impuesta a las importaciones de placa de acero en rollo..., 20.05.2003) and a second time on June 7, 2007 for a period of five years starting on June 7, 2006 (Resolución final del examen de vigencia de la cuota compensatoria impuesta a las importaciones de placa de acero en rollo..., 28.05.2007).
 
On 6 June 2016, the Mexican Ministry of Economy initiated a sunset review of the anti-dumping duty imposed on imports of the above product from Russia. This review follows the application lodged on 26 and 29 April 2016 by Ternium México, SA de CV and Altos Hornos de México, SAB de CV. The existing anti-dumping measure remains in force during the review.

On 2 May 2017, the Mexican authorities issued resolution extending the definitive antidumping duty on imports of the subject good from Russia following the conclusion of the above sunset review. The rate of duty remains at 29.30%. This duty is in force for a period of five years starting from 8 June 2016.
