Safeguard

On 22 June 2011, the Customs Union issued Decree 706 introducing a safeguard duty on imports of certain pipes made of corrosion-resistant steel until 1 November 2012. The rate of duty is 9.9% of the customs value with a minimum threshold of USD 1,500 per 1 tonne. The decree came into force on 1 January 2012. Developing countries that are users of the tariff preferences system of the Customs Union are exempt from the duty with the exception of China, Chinese Taipei, Hong Kong and Macau as well as Brazil. The products subject to duties are classified under the following HS code subheadings: 7304 11 000 1, 7304 11 000 2, 7304 11 000 3, 7304 11 000 4, 7304 11 000 8, 7304 41 000 9, 7304 49 100 0, 7304 49 930 1, 7304 49 930 9, 7304 49 950 1, 7304 49 950 9, 7304 49 990 0, 7306 11 100 0, 7306 11 900 0, 7306 40 200 1, 7306 40 200 9, 7306 40 800 9.

On 31 August 2011, the Russian authorities initiated a sunset review of the safeguard duty imposed on imports of the subject good.

On 22 September 2012, the Russian authorities extended the safeguard measure imposed on certain pipes made of corrosion-resistant steel until 1 November 2014 following the conclusion of a sunset review. The definitive safeguard measure is applied as a quota of 26,887 tonne per year for the imports of subject good into the Customs Union. The quota is applied on a country-specific basis and is allocated as follows: the European Union: 9,946 tonne, Ukraine: 5,784 tonne, China (including Chinese Taipei, Hong Kong, and Macao): 8,208 tonne, and other countries: 2,949 tonne.
 
On 22 August 2013, the Eurasian Economic Commission (according to Decision No. 6) initiated a special safeguard re-investigation concerning pipes and tubes of stainless steel, imported into the common territory of the CU. With Decision No. 268 of 26 November 2013, it was terminated with allocation until 1 November 2014 of import quotas for Belarus, Russia and Kazakhstan for imports, originating from the EU, Ukraine, China and other (not explicitly specified) countries. Compared to the allocated import quotas for 2012 and 2013, in all cases with the sole exception of the import quota of Russia for third countries, the import quotas valid until 1 November 2014 were decreased.
 
The measure is not applied to the product originating from the developing countries under of the CU's Tariff Preferences System except for China, Brazil and Malaysia.
