NoOn August 31, 2011, the Mexican authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of flat hot-rolled steel products from Russia and Ukraine (Resolución final del examen de vigencia de las cuotas compensatorias impuestas a las importaciones de lámina rolada en caliente..., 31.08.2011). The products subject to the duty are classified under the following HS codes: 7208.1099, 7208.2601, 7208.2701, 7208.3801 and 7208.3901. The rate of the duty is 21% on imports from Russia (for all Russian exporters) and 25% on imports from Ukraine (for all Ukrainian exporters). This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on September 9, 2011, for a period of five years (from March 29, 2010 onwards). This duty follows an expiry review requested on February 18, 2010 by Ternium México S.A. de C.V. and Altos Hornos de México S.A.B. de C.V. A review was then initiated by the Mexican Ministry of Economy on March 2, 2010 (Resolución por la que se declara de oficio el inicio del examen de vigencia de la cuota compensatoria impuesta a las importaciones de lámina rolada en caliente..., 02.03.2010). The review started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on March 17, 2010.
The original anti-dumping duty entered into force on March 29, 2000 (Resolución final de la investigación anti-dumping sobre las importaciones de lámina rolada en caliente..., 13.03.2000). It was then extended on March 18, 2006 for a period of five years starting on March 29, 2005 (Resolución final del examen de vigencia de la cuota compensatoria impuesta a las importaciones de lámina rolada en caliente..., 28.02.2006).
On March 12, 2015, the Mexican Ministry of Economy decided to initiate a third sunset review of the anti-dumping duty imposed on imports of flat hot-rolled steel products from Russia and Ukraine.
This review follows the application lodged on February 19, 2015 by Ternium México, S.A. de C.V. and Altos Hornos de México, S.A.B. de C.V.
The investigation started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on March 26, 2015. The existing anti-dumping duty remains enforced during the review.
On 28 January 2016, following the conclusion the sunset review, the Mexican Ministry of Economy extended the applied duty above for an additional five year starting from 29 March 2015.
On 26 March 2020, the Mexican authorities initiated a sunset review of the definitive antidumping duty imposed on imports of the subject good from Russia and Ukraine. This follows the application lodged on 19th and 20th of February 2020 by Ternium México, S.A. de C.V. and Altos Hornos de México, S.A.B. de C.V. respectively.
