Anti-dumping

On January 26, 2010, the Mexican authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of ferrosilicomanganese from Ukraine (Resolución final del examen de vigencia de la cuota compensatoria impuesta a las importaciones de ferrosilicomanganeso..., 26.01.2010).
 
The product subject to the duty is classified under the following HS code: 7202.3001. The rate of the duty is 16.59% for all Ukrainian exporters. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on February 9, 2010, for a period of five years (from September 25, 2008 onwards).
 
This duty follows an expiry review requested on August 19, 2008 by Compañía Minera Autlán S.A.B. de C.V. A review was then initiated by the Mexican Ministry of Economy on September 18, 2008 (Resolución por la que se declara de oficio el inicio del examen de vigencia de la cuota compensatoria impuesta a las importaciones de ferrosilicomanganeso..., 18.09.2008). The review started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on September 25, 2008.
 
The original anti-dumping duty entered into force on September 25, 2003 (Resolución final de la investigación anti-dumping sobre las importaciones de ferrosilicomanganeso..., 04.09.2003).
 
On August 16, 2013, Compañía Minera Autlán, S.A.B. de C.V. lodged a request for a second expiry review before the extended duty imposed on January 26, 2010 expires. A review was then initiated by the Mexican Ministry of Economy on August 29, 2013 (Resolución por la que se declara el inicio del examen de vigencia de la cuota compensatoria impuesta a las importaciones de ferrosilicomanganeso..., 29.08.2013). The review started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on September 7, 2013.
On September 29, 2014, the Mexican Ministry of Economy decided upon the continuation of the anti-dumping measure imposed on imports of ferrosilicomanganese originating in Ukraine. The rate of the duty remains 16.59%. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on October 10, 2014, and is applicable for a period of five years, starting on September 25, 2013.
