Anti-dumping

On January 26, 2010, the Mexican authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of high carbon ferromanganese from China (Resolución final del examen de vigencia de la cuota compensatoria impuesta a las importaciones de ferromanganeso alto carbón..., 26.01.2010).
 
The product subject to the duty is classified under the following HS code: 7202.1101. The rate of the duty is 21% for all Chinese exporters. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on February 9, 2010, for a period of five years (from September 26, 2008 onwards).
 
This duty follows an expiry review requested on August 20, 2008 by Compañía Minera Autlán S.A.B. de C.V. A review was then initiated by the Mexican Ministry of Economy on September 18, 2008 (Resolución por la que se declara de oficio el inicio del examen de vigencia de la cuota compensatoria impuesta a las importaciones de ferromanganeso alto carbón..., 18.09.2008). The review started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on September 25, 2008.
 
The original anti-dumping duty entered into force on September 26, 2003 (Resolución final de la investigación anti-dumping sobre las importaciones de ferromanganeso alto carbón..., 04.09.2003).
 
On August 20, 2013, Compañía Minera Autlán, S.A.B. de C.V. lodged a request for a second expiry review before the extended duty imposed on January 26, 2010 expires. A review was then initiated by the Mexican Ministry of Economy on August 29, 2013 (Resolución por la que se declara el inicio del examen de vigencia de la cuota compensatoria impuesta a las importaciones de ferromanganeso alto carbón..., 29.08.2013). The review started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on September 7, 2013, and is still ongoing.
On July 14, 2014, the Mexican authorities terminated the review and decided upon the continuation of the anti-dumping measure imposed on imports of high carbon ferromanganese from China. The rate of the duty remains 21%. This duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on July 31, 2014. It shall be enforced for a period of five years, starting from September 26, 2013.
