On December 18, 2008, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of tires of radial construction (20', 22' and 22.5' diameter) used for buses and trucks from China (Resolução No. 79, 18.12.2008). This follows the conclusion of an investigation initiated in May 2008. The amount of duty in USD per kilogram is 1.33 for all Chinese exporters. The products subject to duty are classified under the following HS code: 4011.2090. This provisional duty entered into force on December 19, 2008 for a period of six months.
On June 9, 2009, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of tires of radial construction (20', 22' and 22.5' diameter) used for buses and trucks from China (Resolução No. 33, 09.06.2009). The amount of this definitive duty in USD per kilogram ranges from 1.12 to 2.59 depending on the Chinese exporter.
This definitive anti-dumping duty entered into force on June 18, 2009 for a period of five years.
On June 16, 2014, the Brazilian authorities decided to initiate a sunset review of the anti-dumping duty imposed by Resolução No. 33 dated June 9, 2009 on imports of tires of radial construction (20', 22' and 22.5' diameter) used for buses and trucks from China (Circular No. 32, 16.06.2014).
This sunset review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on June 17, 2014. It follows a request lodged on January 31, 2014 by the National Association of the Tyre Industry (Associação Nacional da Indústria de Pneumáticos - ANIP).
On April 10, 2015, the Brazilian authorities decided to extend for up to two months, from April 17, 2015, the investigation period to conclude the sunset review initiated on June 16, 2014 (Circular No. 24, 10.04.2015). Circular No. 24 was published in the Federal Official Gazette of Brazil on April 13, 2015.
On April 29th, 2015, the Brazilian authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of truck tires originating in China (Resolution No. 32, 29.04.2015). The amount of the duty still ranges from USD 1.12 to USD 2.59 per kilogram, depending on the company. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on May 4th, 2015, and is applicable for a period of five years.
On 4 May 2020, the Brazilian authorities initiated a sunset review of the definitive antidumping duty imposed on imports of the subject good from China. This follows the application lodged on 27 December 2019 by Associação Nacional da Indústria de Pneumáticos (ANIP). The duty will remain in force for the duration of the review.
