Anti-dumping

On February 14, 2014, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of carbon steel seamless tubes (line pipe) used for oil or gas pipelines, with external diameter not exceeding five nominal inches (141.3 mm) from Ukraine (Circular No. 5, 14.02.2014).
The products subject to investigation are classified under the following HS code: 7304.1900.
The complaint was lodged on January 31, 2014 by Vallourec Tubos do Brasil S.A. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on February 17, 2014.
 
On May 23, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade made a preliminary determination of dumping against imports of carbon steel pipes from Ukraine (Circular No. 23, 23.05.2014). Circular No. 23 was published in the Federal Official Gazette of Brazil on May 26, 2014.
 
On June 18, 2014, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of carbon steel pipes from Ukraine (Resolution No. 41, 18.06.2014). The amount of the duty is USD 637.74 per metric ton, at the exception of the companies Interpipe Niko Tube LLC and PJSC Interpipe NTRP whose exports are subject to a duty of USD 145.78 per metric ton. This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on June 20, 2014, and is applicable for a period of six months.
 
On November 21, 2014, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of carbon steel pipes from Ukraine (Resolution No. 106, 24.11.2014). The amount of the duty is USD 708.60 per metric ton, at the exception of the companies Interpipe Niko Tube LLC and PJSC Interpipe NTRP whose exports are subject to a duty of USD 155.80 per metric ton. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on November 24, 2014, and is applicable for a period of five years.
 
On May 5th, 2015, the Brazilian authorities decided to modify the anti-dumping duty that applies to the companies Interpipe Niko Tube LLC and PJSC Interpipe NTRP (Resolution No. 35, 05.05.2015). The new amount of the duty those companies are subject to is USD 145.26 per metric ton. This modification entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on May 6th, 2015.
