Anti-dumping

On February 6, 2014 the Commissioner of the Australian Anti-Dumping Commission initiated an anti-dumping investigation on imports of silicon metal containing at least 96% but less than 99.99% silicon by weight and silicon metal containing between 89% percent and 96% silicon by weight that contains aluminium greater than 0.20% by weight, of all forms (i.e. lumps, granules or powder) and sizes, from China (Anti-Dumping Notice No. 2014/08).
The products subject to investigation are classified under the following HS code: 2804.6900.
The complaint was lodged on January 10, 2014 by Simcoa Operations Pty Ltd.
An anti-subsidy investigation concerning imports of the same goods originating in China was also initiated (see measure 6058).
 
On May 28, 2014, the Australian Anti-Dumping Commission extended the time granted to issue the Statement of Essential Facts (Anti-Dumping Notice No. 2014/45).
 
On August 25, 2014, the Australian Anti-Dumping Commission further extended the time granted to issue the Statement of Essential Facts (Anti-Dumping Notice No. 2014/76).
 
On October 24, 2014, the Australian Anti-Dumping Commission extended again the time granted to issue the Statement of Essential Facts (Anti-Dumping Notice No. 2014/108, 24.10.2014).
 
On February 23, 2015, the Australian Anti-Dumping Commission issued the Statement of Essential Facts (SEF Report No. 237).
 
On the same day, the Australian Anti-Dumping Commission decided to impose a provisional anti-dumping duty on imports of the above-mentioned products originating in China (Anti-Dumping Notice No. 2015/22).
The rate of the duty is 53.8%, at the exception of the goods produced by the companies Hua'an Linan Silicon Industry Co., Ltd. and Guizhou Liping Linan Silicon Industry Co., Ltd. and supplied through the company Xiamen K Metal Co., Ltd., which are subject to a duty of 14.1%.
It should be noted that this measure is a combination of an anti-dumping measure and an anti-subsidy measure (see measure 6058), i.e. that the rate of the duty accounts for both the anti-dumping duty and the countervailing duty.
 
On April 7, 2015, the Australian Anti-Dumping Commission extended the time granted to issue the Final Report (Anti-Dumping Notice No. 2015/46, 07.04.2015).
 
On June 3rd, 2015, the Australian Anti-Dumping Commission decided to impose a definitive anti-dumping duty on imports of the above-mentioned products originating in China (Anti-Dumping Notice No. 2015/71).
The rate of the duty is 58.3%, at the exception of the goods produced by the companies Hua'an Linan Silicon Industry Co., Ltd. and Guizhou Liping Linan Silicon Industry Co., Ltd. and supplied through the company Xiamen K Metal Co., Ltd., which are subject to a duty of 12.0%.
It should be noted that this measure is a combination of an anti-dumping measure and an anti-subsidy measure (see measure 6058), i.e. that the rate of the duty accounts for both the anti-dumping duty and the countervailing duty.
