Anti-dumping

On August 30, 2012, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of bicycle tires from China, India and Vietnam (Circular No. 42, 30.08.2012). The products subject to investigation are classified under the following HS code: 4011.5000. The complaint was lodged by Industrial Levorin S.A. on May 14, 2012. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on September 3, 2012. On August 20, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to extend for up to six months, from September 3, 2013, the investigation period to determine the existence of dumping in exports of bicycle tires from China, India and Vietnam to Brazil (Circular No. 47, 20.08.2013).
On February 18, 2014, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of bicycle tires from China, India and Vietnam (Resolution No. 5, 18.02.2014). The amount of the duty imposed on imports originating in China ranges from USD 0.28 to USD 3.85 per kilogram, depending on the Chinese producer. The amount of the duty imposed on imports originating in India is USD 2.16 per kilogram, at the exception of the company Govind Rubber Limited whose exports are subject to a duty of USD 1.09 per kilogram. The amount of the duty imposed on imports originating in Vietnam is USD 2.80 per kilogram, at the exception of the company Kenda Rubber (Vietnam) Co., Ltd. whose exports are subject to a duty of USD 0.59 per kilogram. Kevlar and/or polyurethane bicycle tires are not subject to this duty as they are high-performance products. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on February 19, 2014, and is applicable for a period of five years.
