On April 19, 2013, the New Zealand Ministry of Business, Innovation and Employment decided, after having conducted a sunset review, to continue the anti-dumping duty on imports ofdiaries, with or without covers, excluding: diaries with steel ring binders; and wallplanners from China and Malaysia. The product subject to the duty is classified under the following HS code: 4820.1000. This duty follows a sunset review requested on October 4, 2012 by Croxley Stationery Limited. A review was then initiated by the New Zealand Ministry of Business, Innovation and Employment on October 7, 2012. The original anti-dumping duty entered into force in 2007 and was scheduled to expire on October 8, 2012. The rate of the anti-dumping duty ranged from 36% to 164% for Chinese companies and from 12% to 39% for Malaysian companies. A reassessment of the amount of the anti-dumping duty was initiated on April 19, 2013 (on the day the sunset review was completed). On August 8, 2013, the New Zealand Minister of Commerce reassessed the rate of the anti-dumping duty imposed on imports of diaries from China and Malaysia. This reassessed duty entered into force on August 9, 2013 when it is lower than the previous duty charged and on February 1, 2014 when the reassessed duty is higher than the previous duty (depending on the company). The amount of the duty is defined by the New Zealand Customs Service Instructions 'Diaries from China and Malaysia' dated August 8, 2013.
