Anti-dumping

In August 2013, the New Zealand Ministry of Business, Innovation and Employment decided, after having conducted a sunset review, the continuation of the anti-dumping duty on imports of canned peaches (halves, slices and pieces), packed in various concentrations of sugar syrup and in can sizes ranging from 110 grams to 3 kilograms, from South Africa.
The product subject to the duty is classified under the following HS code: 2008.7009.
This duty follows a sunset review requested on December 10, 2012 by Heinz Wattie's Limited.
 
A reassessment of the level of the duty has been initiated. In the meantime, the amount of the duty remains unchanged and is defined by the New Zealand Customs Instructions 'Canned Peaches from South Africa' E/009/CS003/001 dated February 2010.
 
In February 2014, the New Zealand Ministry of Business, Innovation and Employment terminated the reassessment of the level of the duty. On May 29, 2014, the revised duty entered into force: 11% of the customs value-for-duty, at the exception of goods produced by the company Langeberg & Ashton Foods Pty Ltd. which are not subject to a duty but to reference prices. Reference prices are not provided for reasons of confidentiality.
 
The original anti-dumping duty entered into force on August 1, 1996. It has then been reassessed several times. The last full review and reassessment were completed in November 2007 and February 2008 respectively.
 
On April 7, 2014, a new shipper reassessment for the rate of duty applicable to Rhodes Food Group (Pty) Ltd, a South African manufacturer and exporter of canned peaches, was initiated after the company lodged a request. This company did not export the subject goods during the period of investigation examined in the last sunset review and is therefore subject to the residual rate.
On December 19, 2014, the New Zealand authorities completed this reassessment and agreed to determine new specific rates applying to this company: Rhodes Food Group (Pty) Ltd will be subject to reference prices (one for choice grade, one for standard grade and one for sub-standard grade). A notification was published in the New Zealand Gazette on January 15, 2015 but reference prices are not provided for reasons of confidentiality.
