Anti-dumping

On June 14, 2010, the European Commission decided to impose a definitive anti-dumping duty on imports of ammonium nitrate originating in Ukraine.
 
The products subject to the duty are solid fertilizers with an ammonium nitrate content exceeding 80 % by weight. The products subject to the duty are classified under the following HS codes: 3102.3090, 3102.4090, ex 3102.2900, ex 3102.6000, ex 3102.9000, ex 3105.1000, ex 3105.2010, ex 3105.5100, ex 3105.5900 and ex 3105.9091.
 
The amount of the duty in euro per tonne ranged from 29.26 to 33.25 depending on the exact classification of the product. This definitive duty entered into force on June 17, 2010 for a period of two years.
 
This duty followed an expiry review requested on January 22, 2009 by the European Fertilizer Manufacturers Association (EFMA) on behalf of producers representing more than 50% of the EU ammonium nitrate production.
 
The original anti-dumping investigation was launched by the European Commission on October 29, 1999. The complaint was lodged on September 17, 1999 by the European Fertiliser Manufacturer's Association on behalf of producers representing more than 96% of the EU ammonium nitrate production.
 
On July 25, 2000 the European Commission decided to impose a provisional anti-dumping duty on the products under investigation. The amount of the duty in euro per tonne was 33.25 for all Ukrainian companies. This provisional duty entered into force on July 27, 2000 for a period of six months.
 
On January 22, 2001 the European Union decided to impose a definitive anti-dumping duty on the products under investigation. The amount of the definitive duty was similar to the amount of the provisional one, i.e. 33.25 euro per tonne for all Ukrainian companies. This definitive duty entered into force on January 26, 2001.
 
On October 25, 2005, the European Fertilizer Manufacturers Association (EFMA) on behalf of producers representing more than 50% of the EU ammonium nitrate production requested an expiry review.
 
On April 19, 2007, the European Commission decided to extend the definitive anti-dumping duty on imports of ammonium nitrate originating in Ukraine. The amount of the extended duty in euro per tonne ranged from 29.26 to 33.25 depending on the exact classification of the product. This extended definitive duty entered into force on April 25, 2007 for a period of two years.
