Anti-dumping

On May 2, 2012, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of heavy plates from Australia, China, Russia, South Africa, Republic of Korea and Ukraine (Circular No. 19, 02.05.2012). The products subject to investigation are classified under the following HS codes: 7208.5100 and 7208.5200. The complaint was lodged on December 26, 2011 by the company Usinas Siderúrgicas de Minas Gerais S.A. (USIMINAS). The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on May 3, 2012.
 
On December 5, 2012, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to terminate the investigation concerning imports originating in Australia and Russia (Circular No. 63, 05.12.2012). Reason for this decision is that volumes at stake are not significant. Circular No. 63 was published in the Federal Official Gazette of Brazil on December 6, 2012.
 
On October 2, 2013, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of heavy plates from China, South Africa, Republic of Korea and Ukraine (Resolution No. 77, 02.10.2013). The amount of the duty imposed on imports originating in China is USD 211.56 per metric ton. The amount of the duty imposed on imports originating in South Africa is USD 166.63 per metric ton. The amount of the duty imposed on imports originating in Republic of Korea is USD 135.84 per metric ton, at the exception of the company Posco whose exports are subject to a duty of USD 135.08 per metric ton. The amount of the duty imposed on imports originating in Ukraine is USD 261.79 per metric ton. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on October 3, 2013, and is applicable for a period of five years.
