Anti-dumping

On March 23, 2013, the Indian authorities initiated a sunset review of the anti-dumping duty imposed on imports of sodium nitrite from the European Union.
The product subject to investigation is classified under the following HS code: 2834.1000.
This sunset review follows the application lodged by M/s Deepak Nitrite Ltd, Pune on behalf of the domestic industry.
While initiating the sunset review, the Indian authorities decided on April 10, 2013 to extend the existing anti-dumping duty for one year upto and inclusive of April 10, 2014 (Notification No. 04/2013-Customs (ADD), 10.04.2013).
On May 7, 2014, the Indian authorities extended the time for completing the review upto May 22, 2014.
On May 12, 2014, the Indian authorities issued their final findings of the sunset review. They recommended the continuation of the existing anti-dumping measure on imports of sodium nitrite from the European Union.
On August 8, 2014, the Indian authorities issued the notification of extension of the anti-dumping duty imposed on imports of sodium nitrite from the European Union (Notification No. 37/2014-Customs (ADD), 08.08.2014). The amount of the duty is USD 3.00 per metric ton. This duty is effective for a period of five years.
The original anti-dumping investigation on imports of sodium nitrite from the European Union was initiated on November 2, 2001.
On February 1, 2002, the Indian authorities issued their preliminary findings and recommended the imposition of a provisional anti-dumping duty. This provisional duty was imposed on March 28, 2002 (Notification No. 34/2002-Customs, 28.03.2002). The amount of the duty was USD 51.83 per metric ton. This provisional duty was effective upto and inclusive of September 27, 2002.
On October 28, 2002, the Indian authorities issued their final findings and recommended the imposition of a definitive anti-dumping duty. This definitive duty was imposed on November 29, 2002 (Notification No. 132/2002-Customs, 29.11.2002). The amount of the duty remained USD 51.83 per metric ton. This definitive duty was effective from the date of imposition of the provisional anti-dumping duty, i.e. March 28, 2002.
On March 6, 2007, the Indian authorities initiated a first sunset review of the anti-dumping duty imposed on imports of sodium nitrite from the European Union. On March 3, 2008, the Indian authorities issued their final findings of the sunset review. They recommended the continuation of the existing anti-dumping measure. On April 11, 2008, the Indian authorities issued the notification of extension of the anti-dumping duty imposed on imports of sodium nitrite from the European Union (Notification No. 49/2008-Customs (ADD), 11.04.2008). The amount of the duty was INR 25,235 per metric ton (USD 416.460 per metric ton at the exchange rate of September 2, 2014). This duty was effective for a period of five years.
