Anti-dumping

On October 8, 2007, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, initiated a second sunset review of the anti-dumping duty imposed on imports of acrylonitrile butadiene rubber NBR from Germany and South Korea.
The products subject to investigation are classified under the following HS code: 4002.5900.
 
While initiating the sunset review, the Indian authorities decided on October 9, 2007 to extend up to October 9, 2008 the existing definitive anti-dumping duty imposed on October 10, 2002 by Notification No. 111/2002-Customs and modified on September 1, 2005 by Notification No. 78/2005-Customs (Notification No. 109/2007-Customs, 09.10.2007). The amount of the duty imposed on imports originating in South Korea is USD 362.75 per metric ton, at the exception of the company M/s Korea Kumho Petrochemicals Co. Ltd. whose exports are subject to a duty of USD 138.39 per metric ton. The amount of the duty imposed on imports originating in Germany is USD 647.35 per metric ton.
 
On October 4, 2008, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, issued its final findings of the sunset review. It came to the conclusion that in the case of Germany, there is no reason for the continuation of the existing anti-dumping measure. In the case of South Korea, it recommended the continuation of the existing anti-dumping measure.
 
On January 2, 2009, the Indian Ministry of Finance issued the Customs Notification of extension of the anti-dumping duty imposed on imports of acrylonitrile butadiene rubber NBR originating in South Korea (Notification No. 01/2009-Customs, 02.01.2009). The amount of the duty is USD 362.75 per metric ton, at the exception of the companies M/s Korea Kumho Petrochemicals Co Ltd. and M/s LG Chemicals Ltd. whose exports are subject to a duty of USD 38.73 per metric ton. This duty is effective for a period of five years.
 
On December 31, 2013, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, initiated a third sunset review of the anti-dumping duty imposed on imports of acrylonitrile butadiene rubber NBR from South Korea.
This review follows the application lodged by M/s Omnova Solutions (India) Pvt. Ltd., who has claimed to be the sole domestic producer of the subject goods.
 
While initiating the sunset review, the Indian authorities decided on January 23, 2014 to extend up to January 1, 2015 the existing definitive anti-dumping duty imposed on January 2, 2009 by Notification No. 01/2009-Customs (Notification No. 06/2014-Customs (ADD), 23.01.2014).
 
On January 8th, 2015, the Indian authorities extended the time for completing the sunset review up to June 30th, 2015. On June 30th, 2015, the Indian Directorate General of Anti-dumping & Allied Duties, Ministry of Commerce and Industry, issued its final findings and recommended the continuation of the definitive anti-dumping duty imposed on imports of acrylonitrile butadiene rubber NBR from South Korea.
 
On September 4th, 2015, the Indian Ministry of Finance issued the Customs Notification of extension of the anti-dumping duty imposed on imports of acrylonitrile butadiene rubber NBR from South Korea (Notification No. 46/2015-Customs (ADD), 04.09.2015). The amount of the duty is USD 85 per metric ton, at the exception of the companies M/s Kumho Petrochemicals Co. Ltd. and M/s LG Chemicals Ltd. whose exports are subject to a duty of USD 57 and USD 61 per metric ton, respectively. This duty is effective for a period of five years.
