Anti-dumping

On July 21, 2009, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of polypropylene resin from India and the United States of America (Circular No. 41, 21.07.2009). The products subject to investigation are classified under the following HS codes: 3902.1020 and 3902.3000. The complaint was lodged on January 30, 2009 by Braskem S.A. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on July 23, 2009.

On December 8, 2010, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of polypropylene resin from the United States of America (Resolution No. 86, 08.12.2010). The amount of the duty imposed on imports originating in the United States of America is USD 82.77 per ton. The investigation on imports originating in India was terminated without the imposition of an anti-dumping duty due to de minimis dumping margins. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on December 9, 2010, and is applicable for a period of five years.

On December 20, 2010, Braskem S.A. lodged a request to change the way the definitive anti-dumping duty imposed on imports of polypropylene resin from the United States of America is determined. On March 17, 2011, the Brazilian authorities issued a new resolution modifying the anti-dumping duty imposed on imports of polypropylene resin from the United States of America. The modified duty is an ad valorem duty of 10.6%. It entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on March 18, 2011.

On 8 December 2015, the Brazilian authorities initiated a sunset review of the above anti-dumping duty on imports of polypropylene resin from the United States of America (Circular No. 78, 07.12.2016). This review follows a petition lodged on 30 July 2015 by Braskem.
 
On 1 November 2016, the Brazilian authorities extended the definitive anti-dumping duty on the subject good from the United States following the conclusion of the above sunset review. The rate of duty remains at 10.6% ad valorem. The measure is extended for a period of five years.
