On June 27, 2009 China established a preliminary anti-dumping duty on imports of Adipic Acid or AA from Republic of Korea, the EC and the US. The investigation was initiated on November 10, 2008. Ad valorem duty was set at 5.7-16.7% for Republic of Korea, 11.3-30.3% for the European Communities and 16.8-35.4% for the United States.
On November 1, 2009, the Ministry of Commerce of the People's Republic of China (MOFCOM) announced its final decision in the case and imposed a definitive anti-dumping duty on the product originating from the United States, the European Communities and the Republic of Korea. The duty enters into force on November 2, 2009 and will remain in force for 5 years.
On October 31st, 2014, the Ministry of Commerce of the People's Republic of China decided to initiate a sunset review of the anti-dumping duty imposed on imports of adipic acid (hexanedioic acid) from the European Union, South Korea and the United States of America (MOFCOM Announcement No. 72 of 2014, 31.10.2014).
The product subject to investigation is classified under the following HS code subheading: 2917.12.
It follows the application for a review lodged on August 29th, 2014 by PetroChina Liaoyang Petrochemical Branch, Shandong Haili Chemical Industry Co., Ltd., Jiangsu Haili Chemical Industry Co., Ltd., and Shandong Hualu Hengsheng Chemical Industry Co., Ltd. on behalf of the domestic industry.
The investigation started on November 2nd, 2014 and shall end before November 1st, 2015. The existing anti-dumping duty remains in force during the review.
On 23 October 2015, the Ministry of Commerce of the People's Republic of China decided to extend the definitive anti-dumping duty on imports of the above-mentioned goods originating in the European Union, the United States and the Republic of Korea following a sunset review (Announcement No. 39 of 2015). The duty is applied at the same rate as specified in Announcement No. 78 of 2009, Announcement No. 36 of 2011 and Announcement No. 21 of 2014. The measure is in force from 2 November 2015 for a period of 5 years.
