Anti-dumping

On February 27, 2013, the Colombian Ministry of Commerce, Industry and Tourism decided to initiate an anti-dumping investigation on imports of aluminium extrusions from China and Venezuela (Resolution 027, 27.02.2013). The products subject to investigation are classified under the following HS codes: 7604.2100, 7604.2910, 7604.2920, 7608.1090 and 7608.2000. The complaint was lodged on December 21, 2012 by Aluminio Nacional S.A. and Empresa Metalmecánica de Aluminio S.A. on behalf of the Colombian domestic industry. The investigation started on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on March 1, 2013.

On April 29, 2013, the Colombian authorities decided to impose a provisional anti-dumping duty on imports of aluminum extrusions from China and Venezuela (Resolution 0076, 29.04.2013). The amount of the provisional duty imposed on imports from China is the difference between the FOB declared by the importer and the reference FOB set at 3.61 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB. The amount of the provisional duty imposed on imports from Venezuela is the difference between the FOB declared by the importer and the reference FOB set at 3.72 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB. Those provisional anti-dumping duties entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on May 3, 2013, and are applicable for a period of four months.

On September 2, 2013, the Colombian authorities decided to extend for two months the above-mentioned provisional anti-dumping duties imposed on imports of aluminum extrusions from China and Venezuela (Resolution 0219, 02.09.2013).

On November 13, 2013, the Colombian authorities decided to impose a definitive anti-dumping duty on imports of aluminum extrusions from China and Venezuela (Resolution 0304, 13.11.2013). The amount of the definitive duty imposed on imports from China is the difference between the FOB declared by the importer and the reference FOB set at 3.60 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB. The amount of the provisional duty imposed on imports from Venezuela is the difference between the FOB declared by the importer and the reference FOB set at 3.72 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB. Those definitive anti-dumping duties entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on November 13, 2013, and are applicable for a period of three years.
 
On 27 October 2016, the Department of Foreign Trade, Ministry of Commerce, Industry and Tourism initiated a sunset review of the anti-dumping duty imposed on imports of the subject good from China and Venezuela. This follows the application lodged on 13 July 2016 by Aluminio Nacional S.A.; Empresa Metalmecánica de Aluminio S.A.; and COMPAN~I´A S.A. The anti-dumping duty remains in force during the period of investigation.

On 13 October 2017, the Department of Foreign Trade, Ministry of Commerce, Industry and Tourism extended the definitive antidumping duty on imports of aluminium extrusions from China and Venezuela following the conclusion of the sunset review. The rate of duty on imports from China is the difference between the FOB price declared by the importer and the FOB reference price set at USD 3.60 per kilogram. The rate of duty on imports from Venezuela is the difference between the FOB price declared by the importer and the FOB reference price set at USD 3.72 per kilogram. The measure is in force for a period of three years.
