Anti-dumping

On February 16, 2009, the Colombian Ministry of Commerce, Industry and Tourism decided to initiate an anti-dumping investigation on imports of blenders from China (Resolution 0031, 16.02.2009). The products subject to investigation are classified under the following HS code: 8509.4010. The complaint was lodged on December 19, 2008 by Sociedad GROUPE SEB COLOMBIA S.A. on behalf of the Colombian domestic industry. The investigation started on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on February 26, 2009. On April 23, 2009, the Colombian Ministry of Commerce, Industry and Tourism decided to extend up to June 4, 2009 the investigation period before deciding whether to implement a provisional anti-dumping duty or not (Resolution 0186, 23.04.2009). On June 4, 2009, the Colombian authorities decided to impose a provisional anti-dumping duty on imports of blenders from China (Resolution 0261, 04.06.2009). The amount of the provisional duty imposed on imports of blenders from China is the difference between the FOB declared by the importer and the reference FOB set at 12.65 USD per piece. The duty is due only if the FOB declared by the importer is lower than this reference FOB. This provisional anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on June 10, 2009. On August 10, 2009, the Colombian Ministry of Commerce, Industry and Tourism decided to terminate the anti-dumping investigation on imports of blenders from China without imposing a definitive anti-dumping duty. This decision led to the removal of the above-mentioned provisional anti-dumping duty decided on June 4, 2009. This decision entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on August 11, 2009.
