Anti-dumping

On July 5, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of technical porcelain from China (Circular No. 34, 05.07.2013).
The products subject to investigation are classified under the following HS code: 6907.9000.
The complaint was lodged on October 31, 2012 by the National Association of Ceramic Manufacturers (Associação Nacional dos Fabricantes de Cerâmica para Revestimento, Louças Sanitárias e Congêneres - ANFACER).
The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on July 8, 2013.
On June 24, 2014, the Brazilian authorities decided to extend for up to six months, from July 8, 2014, the investigation period to determine the existence of dumping in exports of technical porcelain from China (Circular No. 38, 24.06.2014). Circular No. 38 was published in the Federal Official Gazette of Brazil on June 26, 2014.
On July 3, 2014, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of technical porcelain from China (Resolution No. 53, 03.07.2014). The amount of the duty ranges from USD 3.01 to USD 5.73 per square metre, depending on the producer. This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on July 8, 2014, and is applicable for a period of six months.
On December 18, 2014, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of technical porcelain originating in China (Resolution No. 122, 18.12.2014). The amount of the duty ranges from USD 3.34 to USD 6.42 per square metre, depending on the producer. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on December 19, 2014, and is applicable for a period of five years.
