On November 12, 2008, the Indian authorities initiated an anti-dumping investigation on imports of phosphoric acid of all grades and all concentrations (excluding agriculture/fertilizer grade) from South Korea.
The product subject to investigation is classified under the following HS code: 2809.2020.
On April 24, 2009, the Indian authorities issued their preliminary findings. They recommended the imposition of a provisional anti-dumping duty on imports of phosphoric acid from South Korea. This provisional duty was imposed on June 22, 2009 (Notification No. 74/2009-Customs, 22.06.2009). The amount of this provisional duty is USD 218.63 per metric ton. This provisional duty is effective upto and inclusive of December 21, 2009.
On November 11, 2009, the Indian authorities issued their final findings and recommended the imposition of a definitive anti-dumping duty on imports of phosphoric acid from South Korea. This definitive duty was imposed on December 15, 2009 (Notification No. 140/2009-Customs, 15.12.2009). The amount of this definitive duty is USD 221.64 per metric ton. This definitive duty is effective for a period of five years from the date of imposition of the provisional anti-dumping duty, i.e. from June 22, 2009.
On June 20, 2014, the Indian authorities initiated a sunset review of the anti-dumping duty imposed on imports of phosphoric acid from South Korea.
This sunset review follows the application lodged by M/s Gujarat Alkalies & Chemicals Ltd and Punjab Chemicals.
While initiating the sunset review, the Indian authorities decided on July 23, 2014 to extend upto and inclusive of June 21, 2015 the existing definitive anti-dumping duty imposed on December 15, 2009 by Notification No. 140/2009-Customs (Notification No. 32/2014-Customs (ADD), 23.07.2014).
On June 19th, 2015, the Indian Directorate General of Anti-dumping & Allied Duties, Ministry of Commerce & Industry, issued its final findings of the sunset review. It recommended the continuation of the existing anti-dumping measure.
On August 24th, 2015, the Indian Ministry of Finance issued the Customs Notification of extension of the anti-dumping duty imposed on imports of phosphoric acid originating in South Korea (Notification No. 45/2015-Customs (ADD), 24.08.2015). The amount of the duty is USD 162.52 per metric ton. This duty is effective for a period of five years.
