Anti-dumping

On December 8, 2008, the Indian authorities initiated an anti-dumping investigation on imports of front axle beams and steering knuckles meant for heavy and medium commercial vehicles from China.
The products subject to investigation are classified under the following HS codes: 7326.9099, 7326.1910, 7326.1990, 8708.5000 and 8708.9900.
 
On April 24, 2009, the Indian authorities issued their preliminary findings and recommended the imposition of a provisional anti-dumping duty. This provisional duty was imposed on June 15, 2009 (Notification No. 65/2009-Customs, 15.06.2009). The amount of the duty imposed on imports of front axle beams is USD 0.50 per kilogram. The amount of the duty imposed on imports of steering knuckles is USD 0.69 per kilogram, at the exception of the company Hubei Triring Forging Co. Ltd. whose exports are subject to a duty of USD 0.63 per kilogram. This provisional duty is effective upto and inclusive of December 14, 2009.
 
On March 5, 2010, the Indian authorities issued their final findings and recommended the imposition of a definitive anti-dumping duty. This definitive duty was imposed on April 12, 2010 (Notification No. 50/2010-Customs, 12.04.2010). The amount of the duty imposed on imports of front axle beams is USD 0.63 per kilogram, at the exception of the company Hubei Triring Auto Axle Co. Ltd. whose exports are subject to a duty of USD 0.35 per kilogram. The amount of the duty imposed on imports of steering knuckles is USD 1.11 per kilogram, at the exception of the company Hubei Triring Forging Co. Ltd. whose exports are subject to a duty of USD 0.64 per kilogram. This definitive duty is effective for a period of five years with effect from the date of imposition of the provisional anti-dumping duty, i.e. from June 15, 2009.
 
After some interested parties filed an appeal before CESTAT, challenging the anti-dumping duty imposed by Notification No. 50/2010-Customs dated April 12, 2010, the Indian authorities reconsidered the case. They issued the final findings of this second investigation on April 10, 2012, confirming the final findings of March 5, 2010.
 
On June 13, 2014, the Indian authorities initiated a sunset review of the above-mentioned anti-dumping duty imposed on imports of front axle beams and steering knuckles from China.
This sunset review follows the application lodged by M/s Bharat Forge Ltd., representing the domestic industry.
 
On July 23, 2014, the Indian authorities decided to extend upto and inclusive of June 14, 2015 the definitive anti-dumping duty imposed on April 12, 2010 by Notification No. 50/2010-Customs (Notification No. 30/2014-Customs (ADD), 23.07.2014).
 
On June 8th, 2015, the Indian authorities extended the time for completing the sunset review up to September 12th, 2015.
 
On September 11th, 2015, the Indian Directorate General of Anti-dumping & Allied Duties, Ministry of Commerce & Industry, issued its final findings of the sunset review. It recommended the continuation of the existing anti-dumping measure.
 
On October 21st, 2015, the Indian Ministry of Finance issued the Customs Notification of extension of the anti-dumping duty imposed on imports of front axle beams and steering knuckles originating in China (Notification No. 49/2015-Customs (ADD), 21.10.2015).
The amount of the duty imposed on imports of front axle beams is USD 0.63 per kilogram, at the exception of the company Hubei Tri-ring Auto Axle Co. Ltd. whose exports are subject to a duty of USD 0.35 per kilogram. The amount of the duty imposed on imports of steering knuckles is USD 1.11 per kilogram, at the exception of the company Hubei Tri-ring Forging Co. Ltd. whose exports are subject to a duty of USD 0.64 per kilogram.
This duty is effective for a period of five years.
