NoOn April 11, 2013, the Argentinian authorities decided to initiate an anti-dumping investigation on imports of copper hydroxide/copper oxychloride/cuprous oxide fungicides (not containing bromomethane (methyl bromide) or bromochloromethane) from Chile, Peru, the United States of America and Uruguay (Resolution 48/2013, 11.04.2013). The products subject to investigation are classified under the following HS code: 3808.9291.
The complaint was lodged by Tort Valss S.A. The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on April 19, 2013.
On July 4, 2014, the Argentinian authorities issued their preliminary decision (Resolution 98/2014, 04.07.2014). They decided to continue the investigation without imposing a provisional anti-dumping duty. Resolution 98/2014 was published in the Official Journal of the Argentinian Republic on July 8, 2014.
On October 17, 2014, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of the above-mentioned products originating in Chile and the United States of America (Resolution 765/2014, 17.10.2014). The rate of the duty imposed on imports originating in Chile is 61.04% of the FOB price, at the exception of the company Quimetal Industrial S.A. whose exports are subject to a duty of 7.76% of the FOB price. The rate of the duty imposed on imports originating in the United States of America is 40.55% of the FOB price. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on October 24, 2014, and is applicable for a period of five years. The investigation concerning imports originating in Uruguay (through the company Fanaproqui S.A.) and in Peru (through the company Sales y Derivados de Cobre S.A. - SALDECO S.A.) was terminated without the imposition of any duty.
On 17 October 2019, the Argentinian authorities initiated a sunset review of the definitive antidumping duty imposed on imports of the subject good from Chile and the United States. The review follows application lodged by Tort Valls S.A.
On 16 April 2021, the Argentinian authorities issued a resolution extending the definitive duty imposed on imports of copper hydroxide/copper oxychloride/cuprous oxide fungicides (not containing bromomethane (methyl bromide) or bromochloromethane) from Chile and the United States of America following the conclusion of the sunset review. The rate of the duty imposed on imports originating in Chile is 61.04% of the FOB price. The rate of the duty imposed on imports originating in the United States of America is 40.55% of the FOB price. The resolution extending the definitive duty entered into force on 16 April 2021.
