Anti-dumping

On June 28, 2012, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of basic refractories from China, Mexico and the United States of America (Circular No. 30, 28.06.2012). The products subject to investigation are classified under the following HS codes: 6902.1018 and 6902.1019. The complaint was lodged by the Brazilian Association of Refractories Producers (Associação Brasileira de Fabricantes de Refratários - ABRAFAR) on December 29, 2011. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on July 02, 2012.
 
On 11 June 2013, the authorities announced the closure (without imposition of duties) of the investigation on the imports from the United States, due to the negligible volume of dumped imports. Conversely, the investigation was extended for six months for imports from China and Mexico.
 
On December 18, 2013, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of basic refractories from China and Mexico (Resolução No. 107, 18.12.2013). The amount of the duty in USD per tonne is 536.52 for Chinese exporters and ranges from 277.66 to 370.54 for Mexican exporters (depending on the company). This definitive duty has entered into force on December 19, 2013 for a period of five years.
 
On June 19th, 2015, the Brazilian authorities clarified the tariff lines affected by this anti-dumping measure (Resolução No. 56, 19.06.2015). HS code 6815.9919 was added to the already affected HS codes 6902.1018 and 6902.1019. Resolução No. 56 was published in the Federal Official Gazette of Brazil on June 22nd, 2015.
