Anti-dumping

On September 28, 2007, the Argentinian authorities decided to initiate an anti-dumping investigation on imports of electrical connection terminals (for cable sizes up to 35 mm²) from China and Germany (Resolution 103/2007, 28.09.2007).
The products subject to investigation are classified under the following HS code: 8536.9090.
The complaint was lodged by Zoloda S.A. The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on October 3, 2007.
 
On February 23, 2009, the Argentinian authorities decided to impose a provisional anti-dumping duty on imports of the above-mentioned products originating in China and Germany classified under HS codes 8536.1000, 8536.5090 and 8536.9090 (Resolution 55/2009, 23.02.2009). The rate of the duty imposed on imports originating in China is 850% of the FOB price. The rate of the duty imposed on imports originating in Germany is 53.47% of the FOB price. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on February 26, 2009, and is applicable for a period of four months.
 
On April 1, 2009, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of the above-mentioned products originating in China and Germany classified under HS codes 8536.1000, 8536.5090 and 8536.9090 (Resolution 106/2009, 01.04.2009).
The rate of the duty imposed on imports originating in China is 873.81% of the FOB price. The rate of the duty imposed on imports originating in Germany is 199.63% of the FOB price, at the exception of the company Phoenix Contact GmbH & Co. whose exports are subject to a duty of 74.58% of the FOB price. Moreover, the Argentinian authorities also accepted price undertakings for the German company Weidmüller Interface GmbH & Co. KG.
This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on April 4, 2009, and is applicable for a period of five years. Price undertakings are valid for a period of three years.
 
On March 28, 2011, the Argentinian authorities decided to initiate a review for change of circumstances that led to the imposition of a duty as far as the German exporting company Phoenix Contact GmbH & Co. is concerned (Resolution 57/2011, 28.03.2011). The review started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on April 1, 2011.
 
On April 3, 2012, the Argentinian authorities decided to initiate a sunset review as far as the German exporting company Weidmüller Interface GmbH & Co. KG is concerned (Resolution 77/2012, 03.04.2012). Indeed, the period of validity of its price undertakings was to expire. The current price undertakings remain in force during the review.
 
On October 1, 2012, the Argentinian authorities terminated the review concerning the German company Phoenix Contact GmbH & Co. and decided to accept the price undertakings submitted by the company (Resolution 580/2012, 01.10.2012). Moreover, for the goods that are not subject to price undertakings, a definitive anti-dumping duty of 249.58% is imposed. This definitive duty and the price undertakings entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on October 19, 2012, and is applicable as long as Resolution 106/2009 dated 01.04.2009 remains in force.
 
On September 30, 2013, the the Argentinian authorities terminated the review concerning the German company Weidmüller Interface GmbH & Co. KG (Resolution 568/2013, 30.09.2013). It decided to impose a definitive duty taking the form of minimum FOB export prices. This decision entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on October 2, 2013, and is applicable as long as Resolution 106/2009 dated 01.04.2009 remains in force.
 
On April 4, 2014, the Argentinian authorities decided to initiate a sunset review of the anti-dumping duty imposed on April 1, 2009 by Resolution 106/2009, as well as by Resolution 580/2012 dated 01.10.2012 and Resolution 568/2013 dated 30.09.2013 (Resolution 65/2014, 04.04.2014). This follows the request lodged by Zoloda S.A. The review started on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on May 12, 2014. The different existing anti-dumping measures remain in force during the review.
 
On September 24th, 2015, the Argentinian authorities decided upon the continuation of the anti-dumping measure imposed on imports of electrical connection terminals from China and Germany (Resolution 987/2015, 24.09.2015).
The rate of the duty imposed on imports originating in China is 208% of the FOB export price. The rate of the duty imposed on imports originating in Germany is 138% of the FOB export price. Moreover, the German company Phoenix Contact GmbH & Co. KG. benefits from a price undertaking agreement with the Argentinian authorites. For the goods that are not subject to this price undertaking agreement, the production of the company Phoenix Contact GmbH & Co. KG. is subject to a preferential duty of 99%.
This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on September 30th, 2015, and is applicable for a period of five years.
