Anti-dumping

On March 19th, 2009, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, initiated an anti-dumping investigation on imports of viscose staple fibre (excluding bamboo fibre) from China and Indonesia.
The product subject to investigation is classified under the following HS code: 5504.1000.
The complaint was lodged by the Association of Man Made Fibre Industry of India on behalf of the domestic industry (M/s Grasim Industries Ltd. is the sole domestic producer of the subject good).

On August 5th, 2009, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its preliminary findings and recommended the imposition of a provisional anti-dumping duty on imports of the above-mentioned goods originating in China and Indonesia.
However, no provisional duty was imposed by the Indian Ministry of Finance, Department of Revenue.

On May 17th, 2010, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of the above-mentioned goods originating in China and Indonesia.

On July 26th, 2010, the Indian Ministry of Finance issued the Customs Notification imposing this definitive anti-dumping duty (Notification No. 76/2010-Customs, 26.07.2010).
The amount of the duty imposed on imports originating in China is USD 0.0194 per kilogram. The amount of the duty imposed on imports originating in Indonesia is USD 0.512 per kilogram, at the exception of the companies M/s P T South Pacific Viscose and PT. Indo Bharat Rayon whose exports are subject to a duty of USD 0.103 and USD 0.164 per kilogram respectively.
This definitive duty is effective for a period of five years.

On July 22nd, 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, initiated a sunset review of the anti-dumping duty imposed on imports of viscose staple fibre (excluding bamboo fibre) from China and Indonesia.
This review follows the application lodged by the Association of Man Made Fibre Industry of India on behalf of the domestic industry (M/s Grasim Industries Ltd. is the sole domestic producer of the subject good).

While initiating the sunset review, the Indian authorities decided on August 6th, 2015 to extend up to July 25th, 2016 the existing definitive anti-dumping duty imposed on July 26th, 2010 by Notification No. 76/2010-Customs (Notification No. 37/2015-Customs (ADD), 06.08.2015).
 
On 8 August 2016, following the conclusion the above-mentioned sunset review the Indian Ministry of Finance issued the Customs Notification extending the definitive anti-dumping duty (Notification No. 43/2016-Customs (ADD), 08.08.2016). The amount of the duty imposed on imports originating in or exported from Indonesia is USD 0.103 or 0.512 per kilogram depending on the company. The amount of the duty imposed on imports originating in or exported from China is USD 0.180 or 0.194 per kilogram depending on the company. This definitive duty is in force for a period of five years.
