Anti-dumping

On February 12, 2009, the Ministry of Commerce (MOFCOM) of the People's Republic of China announced to conduct AD investigation on Pure Terephthalic Acid (listed under 29173611 and 29173619 in the import tariffs of the Chinese Customs) from Thailand and the Republic of Korea.
 
And in accordance with Article 24 of Chinese AD Regulations, on February 2, 2010, the MOFCOM released the preliminary determination of AD duty on the Pure Terephthalic Acid from Thailand and the Republic of Korea, holding that there exists a causal link between dumping and injury. In accordance with the Article 25 of Chinese Regulation on AD, in the case where a preliminary determination on dumping, injury and the casual link between the two is affirmative, MOFCOM shall conduct further investigations on the dumping and its amount, the injury and its degree and make final determinations respectively on the basis of their findings.
 
On August 12, 2010, the MOFCOM released the final determination of Notice NO.47 (2010) and decided to levy AD duty on Pure Terephthalic Acid from the Republic of Korea with the AD duty rate ranging from 2.0% to 11.2%, AD duty rate from 6.0% to 20.1% for companies of Thailand. And this measure shall come in to effect since the date of August 12, 2010, and shall have full effect in a period of 5 years.
 
On August 10th, 2015, the Ministry of Commerce of the People's Republic of China decided to initiate a sunset review of the above-mentioned anti-dumping measure (MOFCOM Announcement No. 24 of 2015, 10.08.2015).
This follows the application lodged on June 10th, 2015 by Zhejiang Yisheng Petrochemical Limited Company, Grand Petrochemical Co., Ltd. and Xianglu Petrochemical Co., Ltd. on behalf of the domestic industry.
The existing anti-dumping measure remains in force during the review.

On 11 August 2016, the Chinese authorities extended the definitive antidumping duty on imports of pure terephthalic acid from the Republic of Korea and Thailand following the conclusion of the sunset review. The rate of duty on imports from the Republic of Korea is between 2% and 11.2%. The rate of duty on imports from Thailand is between 6% and 20.1%.
