On November 23, 2012, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, initiated an anti-dumping investigation on imports of solar cells (whether or not assembled partially or fully in modules or panels or on glass or some other suitable substrates) from China, Chinese Taipei, Malaysia and the United States of America.
The products subject to investigation is classified under the following HS code: 8541.4011.
On December 9, 2013, the Indian authorities extended the time for completing the investigation upto May 22, 2014.
On May 22, 2014, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of solar cells from China, Chinese Taipei, Malaysia and the United States of America.
The Indian Ministry of Finance had to issue the Customs Notification imposing this recommended duty within a period of three months. By August 22, 2014, no notification was published, meaning that the Indian Ministry of Finance decided not to follow the recommendation of the Ministry of Commerce and not to impose a definitive anti-dumping duty on the investigated goods.
On the 28 August 2014, the Indian authorities issued a communication deciding not to impose definitive duties on imports of the subject good from China, Chinese Taipei, Malaysia and the United States of America.
