Anti-dumping

On 18 May 2011, the Mexican authorities initiatied of a sunset review investigation on imports of mushrooms of the genus Agaricus from Chile and China. The product subject to investigation is classified under the following HS code subheading: 2003.1001. The duty remains in force during the period of investigation. The duty on imports from China is USD 0.4484 or USD 1.28 per kilogram depending on the company. The duty on imports from Chile is USD 0.1443 per kilogram. The original anti-dumping duty was imposed on 17 May 2006.

On 17 May 2012, the Mexican authorities published the preliminary results of the investigation and confirmed the imposition of anti-dumping duties on the subject product. The Resolution entered into force the day following its publication in the Official Gazette, i.e. on 18 May 2012.

On 26 October 2012, the Mexican authorities extended the anti-dumping duties imposed on mushrooms of the genus Agaricus from Chile and China following the conclusion of the above sunset review. An anti-dumping duty is imposed if the value is lower than the reference price of USD 2.05 per kilogram and is the difference between the custom units value and the reference price. The maximum duty imposed is on imports from China USD 0.6121 or 1.1891 per kilogram depending on the company. The maximum duty imposed on imports from Chile is USD 0.3712 per kilogram. The measure is extended from 18 May 2011 for a period of five years.

On 17 May 2016, the Mexican authorities initiated a sunset review on imports of the subject good from China and Chile. The complaint was lodged on 18 March 2016 by Hongos de México, S.A. de C.V. The anti-dumping duty amended on 26 October 2012 remains in force during the period of the investigation.
On 4 April 2017, the Mexican authorities extended the definitive anti-dumping duty on imports of the subject good from China following the conclusion of the above sunset review. The rate of duty remains at USD 0.6121 or 1.1891 per kilogram depending on the company. This duty is in force for a period of five years starting from 18 May 2016. The sunset review concerning imports of the subject good from Chile is terminated without the imposition of anti-dumping duties.
