Anti-subsidy

On March 25, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-subsidy investigation on imports of polypropylene resin (existing in two different forms: 1/ polymers of propylene or of other olefins, in primary forms; polypropylene unloaded (HOMO); 2/ polymers of propylene or of other olefins, in primary forms; propylene copolymers (COPO)) from India and South Africa (Circular No. 16, 25.03.2013). The products subject to investigation are classified under the following HS codes: 3902.1020 and 3902.3000. The complaint was lodged by Braskem S.A. and Braskem Petroquímica S.A. on July 31, 2012. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on March 26, 2013. On February 21, 2014, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to extend for up to six months, from March 26, 2014, the investigation period to determine the existence of subsidy in exports of polypropylene resin from India and South Africa to Brazil (Circular No. 9, 21.02.2014).
On 24 September 2014, the Brazilian authorities terminated the above investigation without the imposition of duties. This follows on request from the above applicants.
