Anti-dumping

On March 8, 2013, the Colombian Ministry of Commerce, Industry and Tourism decided to initiate an anti-dumping investigation on imports of flexible PVC films from China and on imports of rigid PVC films from China and South Korea (Resolution 0031, 08.03.2013).
The products subject to investigation are classified under the following HS codes: 3920.4300 and 3920.4900.
The complaint was lodged on November 26, 2012 by FILMTEX S.A.S. on behalf of the Colombian domestic industry. The investigation started on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on March 13, 2013.
On May 14, 2013, the Colombian authorities decided to impose a provisional anti-dumping duty on imports of flexible PVC films from China classified under HS code 3920.4300 (Resolution 0093, 14.05.2013). The amount of the provisional duty imposed on imports of flexible PVC films from China is the difference between the FOB declared by the importer and the reference FOB set at 3.21 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB. This provisional anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on May 17, 2013, and is applicable for a period of four months. No provisional duty was imposed on imports of rigid PVC films from China and South Korea (HS code 3920.4900).
On August 13, 2013, the Colombian Ministry of Commerce, Industry and Tourism decided to extend up to September 6, 2013 the investigation period before having to present the final results of the investigation (Resolution 0206, 13.08.2013).
On September 12, 2013, the Colombian authorities decided to extend for two months the above-mentioned provisional anti-dumping duty imposed on imports of flexible PVC films from China (Resolution 0225, 12.09.2013).

On November 13, 2013, the Colombian authorities decided to impose a definitive anti-dumping duty on imports of flexible PVC films from China and on imports of rigid PVC films from China and South Korea (Resolution 0305, 13.11.2013). The amount of the definitive duty imposed on imports of flexible PVC films from China is the difference between the FOB declared by the importer and the reference FOB set at 3.21 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB. The amount of the definitive duty imposed on imports of rigid PVC films from China is the difference between the FOB declared by the importer and the reference FOB set at 3.29 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB. The amount of the definitive duty imposed on imports of rigid PVC films from South Korea is the difference between the FOB declared by the importer and the reference FOB set at 3.18 USD per kilogram. The duty is due only if the FOB declared by the importer is lower than this reference FOB.
Those definitive anti-dumping duties entered into force on the day of the publication of the resolution in the Official Journal of the Republic of Colombia, i.e. on November 13, 2013, and are applicable for a period of three years.

On 13 September 2016, the Colombian authorities initiated a sunset review of the antidumping duty imposed on imports of the subject good from China and the Republic of Korea. This follows the application lodged by FILMTEX S.A.S. The definitive anti-dumping duty remains in force during the period of review.

On 12 July 2017, following the conclusion of the above sunset review, the Colombian authorities extended the definitive antidumping duty on imports of rigid PVC films from China and the Republic of Korea falling under HS code subheading 3920.49.00.00. The rate of duty on imports from China is 7.17% of the FOB value declared by the importer. The rate of duty on imports from the Republic of Korea is 12.77% of the FOB value declared by the importer. The duty is in force for a period of two years. The definitive duty imposed on imports of flexible PVC films from China falling under HS code subheading 3920.43.00.00 is terminated.
