Anti-dumping

On 24 June 2011, the South African authorities initiated a sunset review investigation on frozen chicken of the species Gallus domesticus, cut in pieces with bone imported from the United States. The products subject to investigation are classified under the following HS code: 0207.14.90. The request for a review was lodged FC Dubbelman and Associates on behalf of Southern Africa Poultry Association.
 
On 5 April 2012, the South African authorities decided to extend the anti-dumping duties in force on the subject product for an additional period of five years. The rate of duty ranges between 224cent (approx. USD 0.29) per kg and 940cent (approx. USD 1.2) per kg.
 
On 18 December 2015, the South African authorities imposed a temporary rebate of the anti-dumping duty on the subject good. From the this date up to and including 31 March 2016 the rebate is subject to a basic quota of 16,250 metric tons. From 1 April 2016 the basic annual quota is 65,000 metric tons. From 1 April 2017 the Department of Agriculture, Forestry and Fisheries will determine the annual growth factor applied to this basic quota. This rebate is limited to South Africa and the subject good imported under this rebate may not be exported to the remaining territory of SACU. Rebates are obtained through a permit issued by the International Trade Administration Commission. Permits are issued on a first come first served basis.
 
On 24 March 2017, the International Trade Administration Commission of South Africa initiated a sunset review on imports of frozen bone-in portions of fowls from the United Sates of America. The products subject to investigation are classified under the following HS code: 0207.14.91, 0207.14.93, 0207.14.95, 0207.14.96, 0207.14.97, 0207.14.98 and 0207.14.99. This follows the application was lodged on 25 October 2016 by the South African Poultry Association.
