Anti-dumping

On February 28, 2013, the European. Commission announced the initiation of an anti-dumping investigation on imports of solar glass from China (Notice No 2013/C 58/06). The product investigated is tempered soda-lime-flat-glass with an iron content of less than 300 ppm, a solar transmittance of more than 88%, a resistance to heat up to 250°C, a resistance to thermal shocks of 150K and having mechanical strength of 90N/mm2 or more.
The product subject to investigation is classified under the following HS code: ex 7007.1980.
The complaint was lodged on January 15, 2013 by EU ProSun Glass on behalf of producers representing more than 25% of the EU production of the subject good.
 
On November 26, 2013, the European. Commission decided to impose a provisional anti-dumping duty on the above-mentioned product originating in China (Commission Regulation (EU) No 1205/2013). The rate of the duty ranges from 17.1% to 42.1% of the net free-at-Union-frontier price, depending on the company. This duty entered into force on the day following the publication of the regulation in the Official Journal of the European Union (L 316), i.e. on November 28, 2013, and is applicable for a period of 6 months.
 
On May 13, 2014, the European authorities decided to impose a definitive anti-dumping duty on imports of solar glass originating in China (Commission Implementing Regulation (EU) No. 470/2014, 13.05.2014). The rate of the definitive duty ranges from 0.4% to 36.1% of the net free-at-Union-frontier price, depending on the exporting company. This duty entered into force on the day following the publication of the regulation in the Official Journal of the European Union (L 142), i.e. on May 15, 2014.
 
On December 19, 2014, the European. Commission announced the initiation of an absorption investigation concerning imports of solar glass originating in China, to investigate whether the anti-dumping measures imposed on those goods have had an effect on export prices, resale prices or subsequent selling prices in the Union (Notice No 2014/C 457/07).
The complaint was lodged on November 12, 2014 by EU ProSun Glass on behalf of producers representing more than 25% of the EU production of the subject good.
 
On April 14th, 2015, the European. Commission amended Commission Implementing Regulation (EU) No. 470/2014 dated May 13th, 2014 (Commission Implementing Regulation (EU) No. 2015/588, 14.04.2015). The rate of the duty still ranges from 0.4% to 36.1% of the net free-at-Union-frontier price, depending on the company. For more details, see Articles 1 and 2 of the regulation.
Commission Implementing Regulation (EU) No. 2015/588 entered into force on the day following its publication in the Official Journal of the European Union (L 98), i.e. on April 15th, 2015, and shall apply retroactively as from May 15th, 2014.
 
On August 13th, 2015, the European. Commission terminated the absorption investigation initiated on December 19th, 2014 and came to the conclusion that the sampled exporting producers absorbed the anti-dumping duty in force (Commission Implementing Regulation (EU) No. 2015/1394, 13.08.2015). Hence, it decided to modify the anti-dumping duty in force.
The rate of the modified duty ranges from 17.5% to 75.4% of the net free-at-Union-frontier price, depending on the company. For more details, see Article 1 of the regulation.
This decision entered into force on the day following the publication of the regulation in the Official Journal of the European Union (L 215), i.e. on August 15th, 2015.
