Anti-dumping

On January 21, 2013, the Moroccan authorities initiated an anti-dumping investigation on imports of hot- rolled steel sheets from the European Union and Turkey.
The products subject to investigation are classified under the following HS codes: 7208 (excluding 7208.10 and 7208.40), 7211.13, 7211.14 and 7211.19.
This follows the application lodged on November 20, 2012 by Maghreb Steel.
 
On October 30, 2013, the Moroccan authorities issued their preliminary report and recommended the imposition of a provisional anti-dumping duty.
On November 21, 2013, the decree imposing this provisional duty was published in the Official Gazette of the Kingdom of Morocco. The rate of the duty imposed on imports originating in the European Union is 29.12%, at the exception of the companies Tata Steel and Steel Link whose exports are subject to a duty of 22.11%. The rate of the duty imposed on imports originating in Turkey is 29.12%, at the exception of the companies Colakoglu and Erdemir whose exports are not subject to the payment of a duty. This provisional duty entered into force on the day of the publication of the regulation in the Official Gazette and is applicable for a period of six months.
 
On April 17, 2014 the Moroccan authorities proposed a modification of the provisional duty imposed on imports originating in the European Union as far as the company Arcelor Mittal is concerned. Arcelor Mittal would be granted a more favourable rate of 15.04%.
On June 5, 2014, the decree confirming this modification of the provisional duty was published in the Official Gazette of the Kingdom of Morocco. It entered into force retroactively.
 
On August 12, 2014, the Moroccan authorities issued their final report and recommended the imposition of a definitive anti-dumping duty.
On October 2, 2014, the decree imposing this definitive duty was published in the Official Gazette of the Kingdom of Morocco. The rate of the duty imposed on imports originating in the European Union is 22.11%, at the exception of the company Arcelor Mittal whose exports are subject to a duty of 11.06% The rate of the duty imposed on imports originating in Turkey is 11%. This definitive duty entered into force on the day following the publication of the regulation in the Official Gazette, that is on October 3, 2014, and is applicable for a period of five years.
 
On June 17th, 2015, the Moroccan authorities decided to exclude some goods from the scope of the above-mentioned anti-dumping measure. This decision follows the difficulties of the domestic producer Maghreb Steel in making supply meeting demand. The official notification was published in the Official Gazette of the Kingdom of Morocco on July 16th, 2015.
