On December 19, 2012, the Indonesian Safeguards Committee started a safeguard investigation on imports of flat-rolled products of iron or non-alloy steel, of a width of 600 mm or more, clad, plated or coated with aluminium-zinc alloys, containing by weight less than 0.6% of carbon, with a thickness not exceeding 1.2mm (WTO Document, G/SG/N/6/IDN/22, 08.01.2013).
The products subject to investigation are classified under the following HS code: 7210.6111.
The investigation was initiated following an application for safeguard measures lodged on December 12, 2012 by PT. Bluescope Steel Indonesia and PT. Sunrise Steel.
According to the UN Comtrade Database, in 2011 the following countries exported goods classified under HS code subheading 7210.61 to Indonesia with a trade value over the GTA threshold of USD 1 million: Vietnam (USD 91.33 million), South Korea (USD 13.25 million), Thailand (USD 7.15 million), Japan (USD 6.82 million), China (USD 2.40 million) and Singapore (USD 1.65 million).
On July 7, 2014, the Indonesian authorities decided to impose a definitive safeguard measure on imports of the above-mentioned products classified under HS code 7210.6111 (Regulation of the Ministry of Finance of the Republic of Indonesia No. 137/.1/PMK. 011/2014). The amount of the duty is IDR 4,998,784 per ton (USD 381.76 per ton at the exchange rate of 10/03/2015) during the first year; IDR 4,314,161 per ton (USD 329.48 per ton at the exchange rate of 10/03/2015) during the second year; and IDR 3,629,538 per ton (USD 277.19 per ton at the exchange rate of 10/03/2015) during the third year.
Regulation No. 137/.1/PMK. 011/2014 was enacted on July 15, 2014. This definitive safeguard measure entered into force 7 days after the enactment of the resolution, i.e. on July 22, 2014, and is applicable for a period of three years.
According to the UN Comtrade database, Vietnam, South Korea, Thailand, Japan, China and Singapore are the affected trading partners taking into account the GTA threshold of USD 1 million trade flows. However, Thailand and China are part of the list of countries that are not subject to this safeguard duty (Annex to Regulation of the Ministry of Finance of the Republic of Indonesia No. 137/.1/PMK. 011/2014).
On 18 January 2017, the Indonesian Anti-Dumping Committee (KADI) initiated a sunset review of the above measure. This follows the application lodged by PT. NS BlueScope Indonesia and PT. Sunrise Steel.
On 3 October 2017, the Indonesian authorities extended the safeguard duty imposed on imports of flat-rolled product of iron or non-alloy steel for a period of two years. The rate of duty between 3 October 2017 and 2 October 2018 is Rp 2,891,858 (USD 213.53) per ton. The rate of duty between 3 October 2018 and 2 October 2019 is Rp 2,186,030 (USD 161.41) per ton. A number of developing countries are exempt from the safeguard duty.
On 22 March 2019, the Indonesian authorities amended Regulation No. 130/PMK.010/2017 thereby terminating the definitive duty from 28 March 2019.
