Anti-dumping

On December 27, 2012, the Argentinian authorities decided to initiate an anti-dumping investigation on imports of certain types of guard and strip (made of glazed or unglazed ceramic (except porcelain coating), marble, travertine or glass) from Brazil, China and Spain (Resolution 186/2012, 27.12.2012).
The products subject to investigation are classified under the following HS codes: 6802.1000, 6802.9100, 6907.1000, 6907.9000, 6908.1000, 6908.9000, 7016.1000 and 7016.9000.
The complaint was lodged by Ince S.A. and Cerámicas Acuarela S.R.L. The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on January 3, 2013.
On June 6, 2014, the Argentinian authorities issued their preliminary decision (Resolution 80/2014, 06.06.2014). They decided to continue the investigation without imposing a provisional anti-dumping duty. Resolution 80/2014 was published in the Official Journal of the Argentinian Republic on June 13, 2014.
On July 2, 2014, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of the above-mentioned products originating in Brazil, China and Spain (Resolution 309/2014, 02.07.2014). The amount of the duty imposed on imports originating in Brazil is: USD 41.10 per square metre for ceramic items, USD 109.50 per square metre for marble or travertine items and USD 7.65 per square metre for glass items. The amount of the duty imposed on imports originating in China is: USD 50.03 per square metre for ceramic items, USD 108.69 per square metre for marble or travertine items and USD 11.42 per square metre for glass items. The amount of the duty imposed on imports originating in Spain is: USD 37.07 per square metre for ceramic items, USD 129.52 per square metre for marble or travertine items and USD 3.21 per square metre for glass items. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on August 6, 2014, and is applicable for a period of five years.
