On May 23, 2012, the Indian Directorate General of safeguards initiated a safeguard investigation on imports of dioctyl phthalate.
The product subject to investigation is classified under the following HS code: 2917.3920.
This follows the application lodged by M/s KLJ Plasticizers Ltd., M/s N K Polymers & Additives Mfg Co., M/s Payal Polyplast Ltd. and M/s PCL Oil & Solvents Ltd., which account for 91% of the domestic production of the subject good.
According to the UN Comtrade Database, in 2011 the following countries exported goods classified under HS code subheading 2917.39 to India with a trade value over USD 1 million: South Korea (USD 34.14 million), China (USD 18.78 million), Singapore (USD 12.73 million), Belgium (USD 4.80 million), Malaysia (USD 4.42 million), the United States of America (USD 4.08 million), Spain (USD 3.97 million), Japan (USD 3.86 million) and Germany (USD 1.24 million).
On November 16, 2012, the Indian Directorate General of safeguards issued its final findings and recommended the imposition of a definitive safeguard duty for a period of 2 years, at a rate of 15% the first year and 10% the second year.
As of October 28, 2014, the Indian Ministry of Finance has not issued the Customs Notification imposing this definitive safeguard duty yet.
