On 29 August 2012, the European Commission announced the initiation of an anti-dumping investigation on imports of biodiesel originating in Argentina and Indonesia.
The complaint was lodged on 17 July 2012 by the European Biodiesel Board.
The following HS codes are considered: ex 1516 20 98, ex 1518 00 91, ex 1518 00 95, ex 1518 00 99, ex 2710 19 43, ex 2710 19 46, ex 2710 19 47, 2710 20 11, 2710 20 15,
2710 20 17, ex 3824 90 97, 3826 00 10 and ex 3826 00 90.
On January 28, 2013, the European Commission released a regulation (Commission Regulation (EU) No 79/2013) introducing mandatory registering/tracking of all imports, with respect to biodiesel, originating in Argentina and Indonesia (see measure 4176). This measure was meant to allow for retroactive imposing of duties in case the investigation leads to the introduction of an anti-dumping duty on the above-mentioned products.
On May 27, 2013, the Commission announced the imposition of a provisional anti-dumping duty on the product under investigation (Commission Regulation (EU) No 490/2013). The duty is applicable for a period of 6 months, starting on May 29, 2013. With this regulation imposing a provisional duty, the mandatory registering/tracking of those imports imposed by Commission Regulation (EU) No 79/2013 dated January 28, 2013 ceased.
On November 19, 2013, the European authorities decided to impose a definitive anti-dumping duty on the product under investigation (Council Implementing Regulation (EU) No 1194/2013). The rate of the duty in euro per tonne ranges from 216.64 to 245.67 for Argentinian companies (depending on the company) and from 76.94 to 178.85 for Indonesian companies (depending on the company). This definitive duty entered into force on November 27, 2013.
On 20 September 2017, the European Commission amended the definitive antidumping duty on imports of the subject good from Argentina and Indonesia. The rate of duty on imports from Argentina is between USD 43.18 and 79.56 per tonne depending on the company. The rate of duty on imports from Indonesia is USD 76.94 and 178.85 per tonne.
