Anti-dumping

On December 10, 2010, the Argentinian Ministry of Economy and Public Finance decided to initiate an anti-dumping investigation on imports of paper and paperboard, coated on one or both sides with kaolin, from Austria, China, Finland, the Republic of Korea and the United States of America (Resolution 238/2010, 10.12.2010). The products subject to investigation are classified under the following HS codes: 4810.1389, 4810.1390, 4810.1989 and 4810.1990. The complaint was lodged by Ledesma S.A.A.I. The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on December 16, 2010.
On March 13, 2012, the Argentinian Ministry of Economy and Public Finance decided to terminate the anti-dumping investigation on imports of the above-metioned product originating in South Korea and to impose a provisional anti-dumping duty on imports of the above-mentioned product originating in Austria, China, Finland and the United States of America (Resolution 63/2012, 13.03.2012).
The rate of the provisional duty imposed on Austrian exports is 143.27% of the FOB price. The rate of the provisional duty imposed on Chinese exports is 39.56% of the FOB price. The rate of the provisional duty imposed on Finnish exports is 145.35% of the FOB price. The rate of the provisional duty imposed on American exports is 63.51% of the FOB price. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on March 21, 2012, and is applicable for a period of four months.
On June 14, 2012, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of certain types of paper and paperboard from Austria, China, Finland and the United States of America (Resolution 298/2012, 14.06.2012).
The rate of the definitive duty imposed on Austrian exports is 98% of the FOB price. The rate of the definitive duty imposed on Chinese exports is 39.56% of the FOB price. The rate of the definitive duty imposed on Finnish exports is 91% of the FOB price. The rate of the definitive duty imposed on American exports is 63.51% of the FOB price. This definitive anti-dumping duty entered into force on the day of the signature of the resolution, i.e. on June 14, 2012, and is applicable for a period of five years. This resolution was published in the Official Journal of the Argentinian Republic on June 21, 2012.

On 13 June 2017, the Argentinian authorities initiated a sunset review of the antidumping duty imposed on imports of the subject good from Austria, China, Finland and the United States of America. This follows the application lodged by LEDESMA S.A.A.I. The duty remains in force for the duration of this investigation.
