Anti-dumping

On February 29, 2012, the Mexican Ministry of Economy decided to initiate an anti-dumping investigation on imports of bikes for kids of all types (12', 14', 16' and 20' wheels) from China (Resolución por la que se acepta la solicitud de parte interesada y se declara el inicio de la investigación anti-dumping sobre las importaciones de bicicletas para niños..., 29.02.2012). The products subject to investigation are classified under the following HS codes: 8712.0002 and 8712.0004. The complaint was lodged on November 29, 2011 by the National Association of Bicycle Producers (Asociación Nacional de Fabricantes de Bicicletas - ANAFABI) and its associated companies: Bicicletas de México S.A., Distribuidora de Bicicletas Benotto S.A., Biciclo S.A., Motos y Bicicletas Goray S.A., Bicicletas Mercurio S.A., Bicicletas Veloci S.A. and Grupo Empresarial Nahel S.A. The investigation started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on March 6, 2012. On July 19, 2012, the Mexican authorities decided to impose a provisional anti-dumping duty on imports of bikes for kids from China (Resolución preliminar de la investigación anti-dumping sobre las importaciones de bicicletas para niños..., 19.07.2012). The amount of this provisional duty is the difference between the declared customs value and the reference price of USD 51.00 per piece, up to a maximal duty of USD 33.01 per unit. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on July 28, 2012 for a period of six months. On February 18, 2013, the Mexican Ministry of Economy decided to terminate the anti-dumping investigation on imports of bikes for kids of all types (12', 14', 16' and 20' wheels) from China after the withdrawal of the complainants on January 23, 2013 (Aviso por el que se declara procedente el desistimiento de la Asociación Nacional de Fabricantes de Bicicletas A.C. y sus empresas asociadas..., 18.02.2013). This decision entered into force on the day following the publication of the notice in the Official Journal of the Federation, i.e. on March 2, 2013.
