Anti-dumping

On July 13, 2010, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an antidumping investigation on imports of n-butyl alcohol from the United States of America (Circular No. 28, 13.07.2010).
The product subject to investigation is classified under the following HS code: 2905.1300.
The complaint was lodged by Elekeiroz S.A. on April 26, 2010. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on July 14, 2010.

On April 7, 2011, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of n-butyl alcohol from the United States of America (Resolution No. 19, 07.04.2011). The amount of the provisional duty ranges from USD 125.74 to USD 244.91 per ton, depending on the exporter. This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on April 8, 2011, and is applicable for a period of six months.
 
On October 5, 2011, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of n-butyl alcohol from the United States of America (Resolution No. 76, 05.10.2011). The amount of the duty ranges from USD 102.67 to USD 272.12 per ton, depending on the exporting company. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on October 6, 2011, and is applicable for a period of five years.
 
On 6 October 2016, the Brazilian authorities initiated a sunset review of the anti-dumping duty imposed by Resolução No. 76 of 5 October 2011 on the subject product imported from the United States (Circular No. 60 of 2016). This review follows a petition lodged on 29 April 2016 by Elekeiroz SA.

On 28 November 2016, the Brazilian authorities initiated a public interest assessment of the definitive duty imposed on imports of the subject good from the United States as well as the definitive duty imposed on n-butanol from South Africa and Russia, see related measure.

On 7 July 2017, the Brazilian authorities amended the definitive duty on imports of the subject good from the United States following the conclusion of the above public interest assessment. The rate of duty is between 9.8% and 28.4% of the CIF ad valorem.

On 1 September 2017, the Brazilian authorities extended the definitive antidumping duty imposed on imports of the subject good from the United States following the conclusion of the above sunset review. The rate of duty is between 9.8% and 28.4% of the CIF value depending on the company. The measure is in force for a period of five years.
