Anti-dumping

On June 7th, 2011, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of polymeric MDI from Belgium, China and the United States of America (Circular No. 30, 07.06.2011).
The products subject to investigation are classified under the following HS code: 3909.3020.
The complaint was lodged on October 20th, 2010 by Bayer S.A., the sole domestic producer of the subject goods. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on June 8th, 2011.

On May 10th, 2012, the Brazilian authorities decided to terminate the investigation as far as Belgium as country of origin is concerned (Circular No. 21, 10.05.2012). Reason for this decision is that the imported volume is not significant. Circular No. 21 was published in the Federal Official Gazette of Brazil on May 11th , 2012.

On the same day, the Brazilian authorities also decided to extend for up to six months, from June 8th, 2012, the investigation period to determine the existence of dumping in exports of polymeric MDI from China and the United States of America (Circular No. 21, 10.05.2012). Circular No. 21 was published in the Federal Official Gazette of Brazil on May 11th , 2012.

On October 29th, 2012, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of polymeric MDI from China and the United States of America (Resolution No. 77, 29.10.2012).
The amount of the duty imposed on imports originating in the United States of America ranges from USD 418.73 to USD 838.08 per metric ton, depending on the company. The amount of the duty imposed on imports originating in China is USD 1,079.68 per metric ton, at the exception of the following companies whose exports are subject to a duty of USD 619.27 per metric ton: Yantai Wanhua Polyurethanes CO. Ltd., Bayer Polyurethanes (Shangai) Co. Ltd., Beijing Keju Chemical Material Co. Ltd., Nanjing Hongbaoli Co., Ltd., Ningbo Wanhua Polyurethane Co. Ltd., Nippon Polyurethane (Ruian) Co. Ltd., Shangai Lianheng Isocyanate Co. Ltd. (SLIC).
This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on October 31st, 2012, and is applicable for a period of five years.

On May 5th, 2015, the Brazilian authorities decided to suspend for one year the levy of the anti-dumping duty imposed on October 29th, 2012 by Resolution No. 77 (Resolution No. 41, 05.05.2014). The reason is an interruption of the domestic production of the goods subject to this anti-dumping measure. This temporary suspension entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on May 7th, 2015.
 
On 24 June 2016, the Brazilian authorities terminated the above definitive duty imposed by Resolution No. 77 of 29 October 2012 (Resolution No. 54, 23/06/2016).
