Anti-dumping

On December 7, 2010, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, initiated an anti-dumping investigation on imports of morpholine from China, the European Union and the United States of America.
The product subject to investigation is classified under the following HS code: 2933.3917.
This follows the application lodged by M/s. Balaji Amines Ltd. on behalf of the domestic industry.
According to the UN Comtrade Database, in 2010 the following EU member states exported goods classified under HS code 2933.39 to India with a trade value over USD 1 million: Germany (USD 17.19 million), Italy (USD 4.62 million), the United Kingdom (USD 2.83 million), the Netherlands (USD 1.82 million) and France (USD 1.17 million).
 
On August 9, 2011, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, issued its preliminary findings and recommended the imposition of a provisional anti-dumping duty on imports of morpholine originating in China, the European Union and the United States of America.
On September 20, 2011, the Indian Ministry of Finance issued the Customs Notification imposing this provisional anti-dumping duty (Notification No. 91/2011-Customs, 20.09.2011). The amount of the provisional duty imposed on imports originating in China is USD 0.63 per kilogram, at the exception of the company M/s Anhui Haoyuan Chemical Group Co. Ltd. whose exports are subject to a duty of USD 0.29 per kilogram. The amount of the provisional duty imposed on imports originating in the European Union is USD 0.68 per kilogram, at the exception of the company M/s BASF SE whose exports are subject to a duty of USD 0.35 per kilogram. The amount of the provisional duty imposed on imports originating in the United States of America is USD 0.81 per kilogram, at the exception of the company M/s Huntsman Petrochemical Corporation whose exports are subject to a duty of USD 0.50 per kilogram. This provisional anti-dumping duty is effective for a period of six months.
 
On December 5, 2011, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce, issued its final findings and recommended the imposition of a definitive anti-dumping duty on imports of morpholine originating in China, the European Union and the United States of America.
On January 24, 2012, the Indian Ministry of Finance issued the Customs Notification imposing this definitive anti-dumping duty (Notification No. 10/2012-Customs (ADD), 24.01.2012). The amount of the definitive duty is identical to the amount of the provisional duty imposed by Notification No. 91/2011-Customs dated 20.09.2011 (see above). This definitive duty is effective for a period of five years from the date of imposition of the provisional anti-dumping duty, i.e. from September 20, 2011.
 
On September 18, 2013, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, decided to initiate a midterm review of the anti-dumping duty imposed on imports of morpholine from China, the European Union and the United States of America.
 
On September 22, 2014, the Indian authorities extended the time for completing the review up to March 17, 2015.
 
On February 19th, 2015, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce and Industry, issued its final findings of the mid-term review and recommended the continuation of the existing anti-dumping measure for imports originating in China and the European Union while the revocation of the existing anti-dumping measure as far as imports originating in the United States of America are concerned (due to absence of dumping or injury effect on the domestic industry).
On May 18th, 2015, the Indian Ministry of Finance issued the Customs Notification implementing this modification (Notification No. 18/2015-Customs (ADD), 18.05.2015). The amount of the duty imposed on imports originating in China remains USD 0.63 per kilogram, at the exception of the company M/s Anhui Haoyuan Chemical Group Co. Ltd. whose exports are subject to a duty of USD 0.29 per kilogram. The amount of the duty imposed on imports originating in the European Union remains USD 0.68 per kilogram (the company M/s BASF SE is no longer granted a preferential treatment). This definitive duty shall remain in force until September 19th, 2016.
