Anti-dumping

On March 2, 2011, the Mexican Ministry of Economy decided to initiate an anti-dumping investigation on imports of monobutyl ethers of ethylene glycol from the United States of America.
The products subject to investigation are classified under the following HS code: 2909.4301.
The complaint was lodged on October 29, 2010 by Polioles, S.A. de C.V.
The investigation started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on March 12, 2011.

On March 20, 2012, the Mexican authorities decided to impose a provisional anti-dumping duty on imports of monobutyl ethers of ethylene glycol originating in the United States of America. The rate of the duty is 37.91%. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on April 10, 2012.

On September 3, 2012, the Mexican authorities decided to impose a definitive anti-dumping duty on imports of the above-mentioned products originating in the United States of America. The rate of this definitive duty is 36.64%, at the exception of the companies Eastman (whose exports are subject to a duty of 14.81%) as well as Dow Chemical (whose exports are subject to a duty of 16.28%) and Union Carbide (same as Dow Chemical). This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on September 12, 2012.

On November 21, 2014, the Mexican Ministry of Economy decided to initiate a review of the anti-dumping duty dated 03.09.2012 imposed on imports of monobutyl ethers of ethylene glycol from the United States of America. This follows the application lodged on September 1, 2014 by Polioles, S.A. de C.V.
The applicant argued that the provisional duty (decided on March 20, 2012) and the definitive duty (decided on September 3, 2012) have had no corrective effect on export prices. It argued that export prices have decreased over time, while domestic prices have increased over the same period, leading in the end to a doubling of the discrimination margin.
The review started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on December 6, 2014.

On June 30th, 2015, the Mexican Ministry of Economy issued its preliminary findings. It decided upon the continuation of the review without modifying the anti-dumping duty imposed on September 3rd, 2012. The resolution was published in the Official Journal of the Federation on July 16th, 2015.
 
On 26 May 2016, the Mexican authorities amended the definitive anti-dumping duty on imports of monobutyl ethers of ethylene glycol from the United States of America following the conclusion of the above review. The rate of duty is amended to 28.43%, with the exception of the companies The Dow Chemical Company and Union Carbide Corporation, which are exempt from anti-dumping duties.

On 11 May 2017, the Mexican authorities amended the definitive antidumping duty on imports of monobutyl ethers of ethylene glycol from the United States of America following the conclusion of a review. The rate of duty is between 9.30% and 36.64% depending on the company.

On 6 September 2017, the Mexican Ministry of Economy initiated a sunset review of the antidumping duty imposed on imports of the subject good from the United States. This review follows the request lodged on 3 August 2017 by Polioles, S.A. de C.V. The existing anti-dumping measure remains in force during the review.

On 6 March 2018, the Mexican authorities terminated the definitive duty imposed on imports of monobutyl ethers of ethylene glycol from the United States of America following the conclusion of a sunset review.
