Anti-dumping

On December 8, 2010, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of light-weight coated paper (coated on both sides, weight between 50 and 72g/m2 wherein the coating weight does not exceed 15g/m2 per side, for offset printing, brightness between 60% and 95%) from Belgium, Canada, Finland, Germany, Sweden, Switzerland and the United States of America (Circular No. 57, 08.12.2010). The products subject to investigation are classified under the following HS code: 4810.2290. The complaint was lodged by Stora Enso Arapoti Indústria de Papel S.A. on April 27, 2010. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on December 10, 2010.
 
On November 9, 2011, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of light-weight coated paper from Belgium, Canada, Finland, Germany, Sweden and the United States of America (Resolution No. 86, 09.11.2011). The amount of the provisional duty imposed on imports originating in Belgium is USD 72.34 per ton, at the exception of the company Sappi Lanaken N.V. whose exports are subject to a duty of USD 64.68 per ton. The amount of the provisional duty imposed on imports originating in Canada is USD 137.95 per ton. The amount of the duty imposed on imports originating in Finland ranges from USD 69.04 to USD 132.86, depending on the exporter. The amount of the duty imposed on imports originating in Germany is USD 101.71 per ton, at the exception of the company Norske Skog Walsum GmbH whose exports are subject to a duty of USD 26.82 per ton. The amount of the duty imposed on imports originating in Sweden is USD 120.37 per ton. The amount of the duty imposed on imports originating in the United States of America is USD 161.72 per ton. Investigation on imports originating in Switzerland was terminated without the imposition of a duty. This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on November 10, 2011, and is applicable for a period of six months.
 
On April 19, 2012, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of light-weight coated paper from Belgium, Canada, Finland, Germany, Sweden and the United States of America (Resolution No. 25, 19.04.2012). The amount of the definitive duty imposed on imports originating in Belgium is USD 96.96 per ton. The amount of the definitive duty imposed on imports originating in Canada is USD 153.28 per ton. The amount of the definitive duty imposed on imports originating in Finland ranges from USD 133.74 to USD 595.29, depending on the exporter. The amount of the definitive duty imposed on imports originating in Germany is USD 106.77 per ton, at the exception of the company Norske Skog Walsum GmbH whose exports are subject to a duty of USD 45.94 per ton. The amount of the definitive duty imposed on imports originating in Sweden is USD 133.74 per ton. The amount of the definitive duty imposed on imports originating in the United States of America is USD 473.76 per ton, at the exception of the company Evergreen Packaging Inc. whose exports are subject to a duty of USD 179.69 per ton. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on April 23, 2012, and is applicable for a period of five years.

On 20 April 2017, the Brazilian authorities initiated a sunset review of the above antidumping duty imposed on the subject good from Germany, Belgium, Canada, the United States, Finland and Sweden (Circular No. 19 of 2017). This review follows a petition lodged by B.O. Paper Brasil Indústria de Papéis Ltda. The antidumping duty is in force during the period of review.

On 9 April 2018, the Brazilian authorities extended the antidumping duty imposed on imports of certain coated paper from Germany, Belgium, Finland and Sweden following the conclusion of a sunset review. The rate of duty from Finland is USD 133.74 or 595.29 per tonne depending on the company. The rate of duty from Germany is USD 45.94 or 106.77 per tonne depending on the company. The rate of duty from Belgium is USD 96.96 per tonne. The rate of duty from Sweden is USD 133.74 per tonne. The duty is in force for a period of five years. No duty was imposed on imports from the United States and Canada.
