Anti-dumping

On December 9th, 2010 through its Foreign Trade Chamber (CAMEX), Brazil made public its decision to continue the application of anti-dumping duties for a further 5 years on pure resin and polyvinyl chloride, not mixed with any other substances, obtained in suspension (PVC-S) from the US and Mexico. The product is classified under the code 3904.10.10 of the Mercosur Common Nomenclature (NCM). The decision is based on the sunset review initiated on 14 December 2009.
The specific anti-dumping duty applied is US$ 1,353.00 - 1.14 x CIF price per tone for the imported goods from the US and US$ 1,023.00 - 1.112 x CIF price per tone for the imported goods from Mexico. This decision was reached after the termination of an anti-dumping review initiated by Brazil on December 10th 2010. As done in a previous review, these prices will be updated every quarter to reflect the new reality of international market of PVC-S.
 
On 30 November 2015, the Brazilian authorities initiated a sunset review of the anti-dumping duty imposed by Ordinance No 792 of 1992, published on 30 December 1992 on resin and polyvinyl chloride, not mixed with any other substances, obtained in suspension (PVC-S) from the US and Mexico (Circular No. 75, 27.11.2015). This review follows a petition lodged on 29 July 2015 by Braskem. The existing anti-dumping measure remains in force during the review period.
 
On 28 September 2016, following the conclusion the above-mentioned sunset review, the Brazilian authorities extended the definitive anti-dumping duty on the above good from Mexico and the United States (Camex Resolution No. 89). The amount of duty on imports from Mexico is 18%. The amount of duty on imports from the United States is 16%. The duty is in force for a period of five years.
