Anti-dumping

On November 19, 2010, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of films, plates, sheets, foils and strips of poly (ethylene terephthalate), thickness between 5 and 50 microns, from Mexico, Turkey and the United Arab Emirates (Circular No. 53, 19.11.2010).
The products subject to investigation are classified under the following HS codes: 3920.6219, 3920.6291 and 3920.6299.
The complaint was lodged on June 14, 2010 by Terphane Ltda. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on November 23, 2010.

On November 4, 2011, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to extend for up to six months, from November 23, 2011, the investigation period before issuing the final determination of the existence of dumping in exports of films, plates, sheets, foils and strips of poly (ethylene terephthalate) from Mexico, Turkey and the United Arab Emirates (Circular No. 52, 04.11.2011).

On February 29, 2012, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of the above-mentioned products from Mexico, Turkey and the United Arab Emirates (Resolution No. 14, 29.02.2012). The amount of the duty imposed on imports originating in Mexico is USD 1,013.98 per ton. The amount of the duty imposed on imports originating in Turkey is USD 646.12 per ton, at the exception of the company Polyplex Polyester Film San. VE TIC. A.S whose exports are subject to a duty of USD 67.44 per ton. The amount of the duty imposed on imports originating in the United Arab Emirates is USD 576.32 per ton, at the exception of the company Flex Middle East Fze. whose exports are subject to a duty of USD 436.78 per ton. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on March 1, 2012, and is applicable for a period of five years.

On 24 February 2017, the Brazilian authorities initiated a sunset review of the antidumping duty imposed by Resolução CAMEX nº 14 of 2012 on the subject good from the United Arab Emirates, Mexico and Turkey (Circular No. 12 of 2017). This review follows a petition lodged on 31 October 2016 by Terphane Ltda. The antidumping duty is in force during the period of review.

On 23 February 2018, the Brazilian authorities extended the antidumping duty imposed on imports of the subject good from Mexico, the United Arab Emirates and Turkey following the conclusion of the above sunset review. The rate of duty on imports from the United Arab Emirates is USD 436.78 or 576.32 per tonne depending on the company. The rate of duty on imports from Mexico is USD 1,013.90 per tonne. The rate of duty on imports from Turkey is USD 67.44 or 646.12 per tonne depending on the company. The duty is in force for a period of five years.
